| Ban on entry of heavy vehicles in Patnitop challenged | | | Early Times Report Jammu, June 7: The high court today issued notice to the state and others in a petition seeking lifting of ban on entry of heavy vehicles in Patnitop area. Justice Sunil Hali issued notice to State of J&K through Chief Secretary, Commissioner/Secretary Housing & Urban Development Dept, Patnitop Development Authority through Chief Executive Officer and contractor Barrier Management Patnitop. Advocate Adarsh Sharma accepted notice on behalf of Patnitop Development Authority and its CEO who shall file objections within four weeks. Court directed petitioners that they shall take steps to serve other respondents within one week. The Chief Executive Officer Patnitop Development Authority banned entry of all heavy Motor-Vehicles including state/ central government heavy vehicles in order to preserve the ecology and environment of Patnitop Area on May 17. The petitioner, Nishant Sharma, who owns a hotel at Patnitop challenged the order on the ground the Patnitop is the prime tourist destination of the Jammu Division and as such is visited by thousands of tourist, visitors and also the pilgrims who visit the Shri Mata Vaishno Devi Shrine Katra. It is further stated that since Patnitop is connected to the rest of the state from both sides Jammu as well as Kashmir by road only as such bus service is the major mode of transportation, which is used by the public at large especially the tourists hailing from outside the state. That bus service to the said area can very easily be termed creditable for high promotion of tourism and trade of the area in general and the trade & business of the petitioner in particular. Petitioner also seeking quashment of condition imposed by Patnitop Development Authority in NIT dated March 4, 2010 for Management of Barriers at Patnitop and Sanasar Road for the year 2010-2011 read with allotment order dated March 31, 2010 issued in favour of the private respondents for restricting the entry of heavy motor vehicles in Patnitop Area. Justice Sunil Hali after hearing Advocates Vikas Magotra and Sachin Sharma appearing for the petitioners has issued notice in CMP also and directed CEO Patnitop Development Authority that he will inform this Court as to how many shops and kiosks have been constructed in the Patnitop Area and as to whether permission for raising such shops and kiosks have been granted to them. CEO PDA shall file status report in this Court by or before July 15, 2010. It is also observed that no further construction of shops of Kiosks will be permitted till the matter is considered by this Court. (JNF)
