| Afzal Guru won't be hanged today | | Home Ministry examining mercy petition | | B L KAK NEW DELHI, OCT. 19: The much-awaited execution of Afzal Guru, mastermind of 2001 Parliament attack case, will not take place on the date fixed by the court--October 20. The postponement of Guru's execution in Delhi's Tihar Jail is attributed to the delay on part of the Union Home Ministry in finalising its decision on the mercy petition handed over to it by the President, APJ Abdul Kalam's office. Afzal Guru, who had declined to personally file mercy petition to the President, would be expected to file his mercy petition by next week, according to his lawyer, Nandita Haksar. She divulged that her client, Afzal Guru,would personally send a petition for mercy to President Kalam. Guru, who is to be executed on Friday morning at Delhi's Tihar Jail, will now get a temporary reprieve through his "personally" filed petition. Answering a question, Nandita Haksar said that Afzal "may be filing" his mercy petition by next week. On the other hand, authoritative sources let it be known on Thursday that Afzal Guru will not be executed on Friday (October 20) as the Ministry of Home Afairs is still going through the mercy potition it received from the Rashtrapati Bhawan. That mercy petition was filed by Guru's wife. According to Indian laws, any mercy plea filed to the President of India is routed to the Home Ministry and then to the Union Cabinet, which then conveys its recommendations to the President. At the same time, the President is not bound to follow the Cabinet's recommendations. He can act on the petition only after receiving them. |
