HC restrains State from disengaging contractual lecturer | | | early times report Jammu, July 14: Justice JP Singh of Jammu & Kashmir High Court, Jammu Wing, today directed Education Department that they should not disengage the petitioner Ankush Jyoti, a contractual lecturer of 10+2 School, from his present assignment, till next date. This significant order was passed in a petition filed by Ankush Jyoti who was engaged as 10+2 Botany lecturer on contract basis in Govt Higher Secondary School, Chokwi Jandrore Tehsil Ramnagar in the year 2006 and is still discharging his duty. The grievance of the petitioner is that Director School Education, Jammu has issued a circular on April 5, 2010 by virtue of which all the CEOs of Jammu Province have been directed not to allow the candidates engaged on academic basis in Higher Secondary School after April, 2010. It is also submitted in the petition that respondents are threatening the petitioner that he would be replaced by a regularly appointed candidate against the mandate of J&K Civil Service (Special Provision) Act 2010. The said act provides that a candidate appointed on contractual basis would be regularized after seven years service and if not completed seven years service he would be allowed to continue at his place of posting till he completes seven years of service and challenged the order of Director School Education. Justice JP Singh after hearing Adv Deeraj Choudhary appearing for the petitioners issued notice Commissioner/Secretary Education Dept, Director School Education Jammu, CEO Udhampur and Principal Govt Higher Secondary School Chokwi Jandrore, Ramnagar and directed the Registry to list this petition in the third week of August. ---(JNF) |
