Grenade attack case: Minor acquitted | | | early times report Jammu, July 21: Third Additional Sessions Judge, Jammu, Mr. RS Jain today acquitted one Mumtaz Ali, who was facing trial for allegedly throwing grenade at the bus on January 11, 2006 at Sola Morh. The accused committed offence to destabilize the security of the country and also to create communal tension in J&K, the accused was challaned for offence u/s 307/ 120-B RPC and 7/27 Arms Act r/w section 3 PSSA. The other accused who was major has already been acquitted.3rd Additional Sessions Judge Mr. RS Jain after hearing APP for the state and Adv Shaysta Katoch appearing for the accused and referred a judgment of Supreme Court and observed that in view of the arguments of Adv Shaysta Katoch appearing for the accused it would be necessary to go through the testimonies of the witnesses examined by the prosecution, the prosecution witnesses Ravi Kumar, Adbul Gani not deposed any thing against the accused in their cross examination. Prosecution witnesses Om Parkash , Kuldeep Kumar, Sunil Sharma, Manohar Lal were declared hostile. Court considered the arguments of APP and counsel for the accused and also gone through the material on record acquitted the accused Mumtaz Ali from the charges leveled against him. ---JNF
