Irregularities in Provident Fund Organization
‘Direct ‘tainted’ officials and concerned minister declare assets’

JAMMU, July 25: While the Provident Fund Commissioner is on leave, his sub-ordinates who enjoy the patronage of the concerned minister seem all set to appoint 25 persons in total violation of recruitment rules. The appointment orders are expected today only.
It all started last year when the Provident Fund Commissioner expressed serious concern over illegal and backdoor appointments made by the additional Provident Fund Commissioner vide his letter No PFC/1141-42 dated February 2, 2010. In response to his queries, the On February 18, 2010, the Under Secretary to Government Labour and Employment Department in his letter NoL&E/EPO/30/09 dated February 18, 2010 writes: "Initially, it had been informed that the Additional Provident Fund Commissioner, Jammu has made only 5 appointments. Now as per the enquiry conducted by you the number of appointments made by him in violation of the procedure is 15 (10 for divisional office, Jammu and 5 for sub-office Kathua). You may kindly appreciate that the government had constituted two committees one each for Jammu and Srinagar for recommending selections. There is absolutely no reason why this mechanism should have been sidelined by the Additional provident Fund Commissioner, Jammu. It has also been learnt that some appointments have been made by the additional provident commissioner Kashmir without taking recourse to the proper selection process." The Under Secretary in the same letter informs that the concerned minister having taking serious note of the bungling ordered termination of all such appointees after expiry of 89 days. He also urged the officials to follow proper procedure for selecting candidates.
Soon after MLA MY Tarigami raised the matter in the Legislative Assembly. Accordingly the honourable Speaker also ordered an enquiry. Vide his order No LA/3459/Legn/2010 dated April 13, 2010 the Financial Commissioner ( Home) was directed to hold enquiry. The enquiry is sill going on. A Jammu based Urdu daily in its May 15 edition wrote that the Speaker had admitted huge bungling in the organization. However, no action was taken. `
To set the organization in order, the Provident Fund Commissioner issued an order on April 24, 2010. The order No PFC/13 of 2010 reads: "Additional Provident Fund Commissioner's of both divisions henceforth shall look after the work of enforcement of provident fund scheme within their jurisdiction under the overall control and superintendence of the provident fund commissioner J&K and they will handover charge of all the CD account heads and allied record to senior accounts officer of their respective divisions."
Surprisingly the concerned minister urged the Commissioner to rescind the order in his communication No PS/HM/HE/L&E/629 dated April 28, 2010. When the commissioner resisted, the minister kept the order in abeyance on his own vide order No PS/HM/HE/L$E/652-60 dated April 30, 2010.
Meanwhile, a board meeting was convened at Jammu on July 11 where the decision of appointing 25 candidates was taken. It was also agreed to place individual provident fund commissioners for Jammu and Kashmir divisions separately. The board also recommended placing both the existing divisional heads as provident fund commissioners under the direct control of the administrative department subject to the conditions that the officers should be post graduate/law graduates with at least 20 years of experience in the organization.
Surprisingly the divisional head for Kashmir, GH Sofi is a post graduate in political science and has more than 25 years of experience in the organization. The divisional head for Jammu, Kamal Mehandroo is a law graduate and has got 23 years of experience in the organization. This recommendation, therefore, has been made to suit these two candidates only. The proposal may be submitted to the government soon to ensure their elevation notwithstanding the enquiry pending against them.
All efforts to contact the divisional heads of the organization failed. The concerned minister, it was reliably learnt, has left for unknown place for holidaying.
The employees have urged the government not to accept the board's recommendations until the misappropriated money of the organization is recovered from them. The employees also urged the government to make the officials declare their assets. "The concerned minister has amassed wealth. He has got a plot at Bathindi, Jammu and is constructing a palatial house at Reasi", they said.
