Court attaches chief secy's account | | | EARLY TIMES REPORT JAMMU, July 25: Additional district judge, Jammu, has ordered the attachment of account head No 2052 of chief secretary (GAD civil secretariate moving treasury of J&K Bank) till a decreetal amount of Rs 68,037 was paid to decree holders. The court directive came in a writ petition filed by Romesh Lal against J&K state and others through advocate R P Sangra. The judge said the attachment of the account would not affect the inflow of cash into it. "As and when the decreetal amount is paid to the decree holders, account head will automatically stand released," he ordered. The judge also said that the concerned treasury officer be informed of the matter. The judge said though the account already stood attached, counsel for the judgement debtor had sought adjournment for depositing the decreetal amount along with interest. He observed that the execution application was pending since 2007 and till date the decree under execution had not been set aside by the judgement debtors. On number of occasions, account heads had been seized and released on the assurances of the advocate for the judgement debtors that payment would be made at the earliest, he added. Though money was deposited by the judgement debtors, an application was filed by decree holder on January 1, 2009, seeking balance amount of the interest of Rs 62,980 which had accrued during the pendency of the execution application. Therefore, a state of account was furnished by the judgement debtors and both the advocates were directed to produce their accountants to verify the statement. The calculation of the decreetal amount was done in the presence of both the advocates which showed that an amount of Rs 68,037 was due towards the decreetal amount till August 2009.
