SC stays contempt proceedings against LAWDA vice-chairman | | | EARLY TIMES REPORT JAMMU, July 26:Justice Aftab Alam and Justice R M Lodha of the Supreme Court have issued notice in the special leave petition filed by lakes and waterways development authority (LAWDA) against the judgement of the division bench of J&K High Court, Srinagar, directing it to pay a compensation of Rs 6,16,015 to one Mohammad Abbas Wanth. It may be recalled that the division bench comprising chief justice Barin Ghosh and Justice M H Attar had decided a writ petition filed by Wanth in his favour on October 29, 2009, and had directed LAWDA to pay the petitioner a sum of Rs 6,16,015. together with interest at the rate of 8 per cent starting from January 1, 1999, as compensation for damage caused to the petitioner’s house because of dredging operations carried out in Dal Lake by LAWDA.On April 19, 2010, Justice Manzoor Mir of J&K high court had issued contempt notice to LAWDA vice-chairman Irfan Yasin for failure to comply with the judgement of the division bench and had directed the amount to be deposited with the high court registry within 4 weeks.LAWDA contends that Wanth’s house suffered no damage and in any event the amount of Rs 6,16,015 had no authentic basis.After hearing Gaurav Pachnanda, senior additional advocate general, J&K, appearing for LAWDA and Irfan Yasin (together with Sunil Fernandes, Advocate-on-Record for the state), the bench comprising Justice Aftab and Justice Lodha condoned the delay of 103 days in filing the 2 SLPs against these 2 orders issued by the division bench and the single judge of the J&K high court, issued notices to the respondents in the SLPs and directed that contempt proceedings against Irfan Yasin shall remain stayed until further orders
