HC dismisses petition filed by doctors seeking appointment under NRHM scheme

Jammu, July 28: In a petition filed by Dr. Taranjeet Singh & others who had applied for the post of allopathic doctor in response to advertisement for filling-up the posts of allopathic doctors, junior staff nurses, ISM pharmacists, laboratory technician and female multipurpose workers on contractual basis.
According to the petitioner, a selection committee constituted by the District Health Society, Jammu conducted interviews of eligible candidates and a list has been prepared, the petitioners stated that they are also included in the said list. Vide order November 17, 2009 Chairman District Health Society, Jammu has withdrawn the selection list prepared by the selection committee on the ground that the said committee has ignored some basis criteria for selection. The petitioners are aggrieved of the same stated that since they figured in the selection list, the respondents should appoint them. The petitioner seeking quashment of the order dated November 17, 2009.
Justice Hakim Imtiyaz Hussain after hearing both the sides observed that in the facts and circumstances of the case, Court does not find any merit in the present petition for the reason that the selection committee has only conducted the interviews and empanelled the candidates. It is not well settled by the various judgments of the Supreme Court that empanelment of the candidate in the select list does not confer any right on the candidate to seek appointment on account of being empanelled and the recommendation of the selection committee is not binding on the appointing authority and same does not create any vested right or give rise to any legitimate expectation in the candidates and quoted the judgment of Supreme Court and further observed that since mere empanelment does not any create any right the petitioners on the basis of empanelment do not have any cause to maintain the present petition and dismissed the same.
