Court grants bail to Kirtan Singh, dismisses case against Principal

Second Additional Sessions Judge Jammu Mr. Ashok Kumar Koul today granted bail to Kirtan Singh s/o Harnam Singh r/o Nanak Nagar Jammu, who is allegedly involved in abetment of suicide of a student of Harminder School.
According to the facts of the case that petitioner Kirtan Singh to this situation is in dispensable whereas petitioner No 2 Surinder Kour w/o Kirtan Singh is Principal Harminder Public School Preet Nagar Jammu. According to the police version, Aman Deep Singh and his brother Jatinder Singh (deceased) were undergoing studies in the said school and had not paid the school fee for past two months and so the petitioner/accused Kirtan Singh demanded fee from the deceased and his brother and had also told them that in case they failed to deposit the fee, they will have to face consequences. On the fateful day both deceased and his brother reached the school to take terminal examination at 9:15 AM. Kirtan Singh assaulted them physically for non-payment of fee and also turned them out of school. Deceased feeling insulted by the attitude of Kirtan Singh took an extreme step and hanged him self to death at home. There was momentary public uproar against the school administration and the media hype, which worsened the situation and ultimately petitioner Kirtan Singh, had to face the onslaught. Petitioner maintained that the deceased and his brother had come to school without uniform on October 11 and were sent to home to return back in proper uniform, one of them committed suicide and public pressure led the police to arrest him. It is also being submitted that Kirtan Singh is Government servant and has no concern with the management of the school, his wife who is Incharge of the administrative control of the school affairs, petitioner so claims to be innocent and pray for his liberty. The Judge after hearing both the sides observed that it is considered view of the court that a case for bail is made out in favour of Kirtan Singh from the fact and evidence collected so far. There is no plausible justification for denying bail to the petitioner. So, without commenting upon the merit of the case, this bail application is allowed and Kirtan is directed to be released from custody immediately provided he furnishes surety bond in the amount of Rs 50,000 and personal bond of like amount. The petition to the extent of Surinder Kour Principal of Harminder Public School is dismissed as not pressed
