Rape accused denied bail

Jammu, Aug 31: Principal Sessions Judge Jammu Ms Bala Joyti today rejected the bail application of Sunil Kumar S/o Sardari Lal r/o Nawa Gagran, Tehsil Pathankot, Punjab who along with Anil Kumar S/o Dev Raj R/o Ramban Maitra at Goura Gali is allegedly involved in kidnapping and rape of two minor girls.
According to the prosecution case that a written complaint filed by father of the prosecutrix that her daughter on May 27,2010 had left for her maternal uncle’s home and on May 29,2010 he has come to know that his daughter along with minor girl while returning from Ind towards their home, were abducted by one Sonu S/o Sardare Lal R/o Nawa Gagran Tehsil Pathankote District Gurdaspur and Anil Kumar S/o Dev Raj R/o Ramban Maitra at Goura Gali as they were waiting therein light vehicle and they abducted his daughter as well as another girl and further forcibly boarded them into vehicle in order to kidnap and rape them and then brought them to Jammu and on the basis of this written complaint FIR was at Police Station Gool. Both the girls were medically recovered from Jammu Bus Stand and a case u/s 363/376/343 RPC was registered and the police presented challan in the Court of law.
The court after hearing the parties observed that in the facts and circumstances of the case when there are serious allegations of abducting and raping of minor girls of less than 16 years. The minor girls are suffering from social stigma and case is at initial stage of the trial as the charges are yet to be framed and the circumstances call for refusal of bail in order to meet the ends of justice. Let it be known that even if the prosecutrix’s are said to be a consenting party under the peculiar circumstances of the case, those are less than 16 years of age in which case her consent to any sexual intercourse, abduction or kidnapping etc is immaterial. On the contrary the intensity of the alleged crime is further augmented considering the tender and juvenile age of the victim girl and that the punishment prescribed for such type of kidnapping is life imprisonment.
With these observations Court dised the bail application. JNF
