Court frames charges in loan scam case

Jammu, Sep 01:- Special Judge Anticorruption Jammu AK Koul framed corruption charges against Ravinder Misra then Assistant Manager, Varinder Kohli then Manager State Financial Corporation and Private Ulhas Dogra alias Vidya Sagar and Kulbir Singh and proceedings u/s 512 CrPC and discharged Ram Dev Sharma then Assistant Manager and Suresh Kumar Raina then Manager.
According to the case, loan of Rs 9.32 lacs was sanctioned by State Financial Corporation (SFC) in favour of Kulbir Singh and Ulhas Dogra in May 1991 for establishing an industrial unit under the name and style of M/S New Electrical Products Jammu. The scheme was in fact sponsored by District Industry Center Jammu and was forwarded to SFC for financial support. The loan amount after being sanctioned was paid in two installments to the unit holders and the first installment was paid vide DD dated February 21, 1992 and second installment on April 2, 1992 and the demand draft were issued in favour of M/S Sindhu International Gill Road Ludhiana who was the supplier of Machinery for the industrial units set-up Kulbir Singh and Ulhas Dogra. It was alleged that Industrial Unit for which loan was sanctioned was never established nor the machinery brought from the supplier.
Special Judge Anticorruption Jammu Mr. AK Koul after hearing Advocates OP Sharma, Firdous Ashiq, PN Raina, RK Kotwal, Rajiv appeared for the accused persons whereas proceedings u/s 512 CrPC has initiated against accused Pal Sajid whereas CPO Purshtom Sharma with Senior PO Parshant Mahajan appearing for the VOJ and gone through the material on record observed that so far as material on record is concerned, same appears to be sufficient to frame charges against accused Ulhas Dogra alias Vidya Sagar, Kulbir Singh u/s 465/468/471/ r/w section 120-B RPC, the accused Ravinder Mishra, Varinder Kohli accordingly charged for the offences u/s 5(2) of PC Act 2006 r/w section 420/467/468/471 RPC and discharged Ram Dev Sharma then Assistant Manager and Suresh Kumar Raina then Manager.
