| HC quashes Doda selection list of ISM doctors | | | EARLY TIMES REPORT
Jammu, Sep 2 :In a significant judgment, Justice Sunil Hali of Jammu & Kashmir High Court (Jammu Wing) quashed the selection list for the post of Medical Officers under National Rural Health Mission in Doda District. The decision was taken in threew writ petitions.
The three writ petitions challenging the selection list on various ground submitted that petitioners being eligible applied for the post of ISM doctors pursuant to the advertisement notice issued on September 30, 2009. The selection process came to be initiated by the committee constituted by the chairman District Rural Health Society, Deputy Commissioner and pursuant there to private respondents came to be selected on contractual basis under the scheme in Doda District.
It has been further submitted that the criterion was subsequently changed by the respondents on December 2, 2009 by fixing that weightage to technical qualification 80 marks and Viva-Voce 20 marks .
It is further stated by the petitioner that on the date when interview was conducted, the criterion for selection was to be disclosed at the time of interview or even before the selection process was initiated. This was not done by the respondents and exorbitant marks were given to private respondents in the interview by changing the merit lastly, the preference was required to be given to those persons, who belong to Blocks for which the posts were advertised
Justice Sunil Hali after hearing Advocates Anil Sethi, TK Raina and Veenu Gupta for the petitioners in three different writ petitions whereas Shaista Hakim Deputy AG appearing for the State whereas Advocates Seema Shekhar and Shivani Jalali appeared for the respondents, observed that admittedly earlier criterion was subsequently changed by the respondents by re-fixing weightage to technical qualification 80 marks and Viva-Voce 20 marks. This was informed to the candidates prior to the initiation of selection but on December 2, 2009 it cannot be said that the petitioners cannot question the criteria. With these observations court allowed petitions and quashed the impugned selection list for the post of Medical Officer under National Rural Health Mission in Doda District with a further direction to respondent to initiate the process of selection a fresh by giving preference to those who are leaving within the blocks in case of non-availability of the candidates within the blocks, the zone of consideration be extended within District and directed the respondents to complete the process within six weeks from the date a copy of this order is made available to the respondents by the petitioners.
