HC directive to DC Reasi on NYC petition | | | Bharat Bhushan EARLY TIMES REPORT JAMMU, Sept 5: In a petition in which NC MLA and higher education minister Abdul Ghani Malik was alleged to have exerted pressure on the authorities concerned to "withhold" the select list of national youth corps (NYC) volunteers for Mahore and Chasana blocks of Reasi, Justice J P Singh of the state high court has ordered Reasi deputy commissioner to allow them to join their duties. The reason cited in the prayer behind the minister's unwarranted intervention in the select list was that he did not have any of his "favourites" in it. The candidates were interviewed on July 19 this year and their select list was issued on August 17. The list was also published in a local daily newspaper in its August 20 issue. While the selected candidates of other blocks were allowed to join duties and function as NYC volunteers, the 58 Mahore and Chasana candidates were not allowed to join. The petition said there was no legal bar to the appointment of the Mahore and Chasana candidates who had been selected on the basis of merit, ability and performance. The petitioners alleged that they were not being given appointment letters because the minister, who was also local MLA, was disappointed with the selection process as "he did not have his favourites" in the select list. It was ostensibly on his instructions that their appointments had been withheld, they alleged. The minister's intervention at a time when the whole selection process had been completed was unconstitutional and uncalled for, they added. There was no legal bar, hindrance, or dispute with regard to their selection and appointment, the petitioners said, alleging that it was at the instance of the minister that they were not being allowed to join their duties. They said when all other options to get appointment letters from the authorities concerned were exhausted, they were left with no option but to approach the court for justice. After hearing advocate Anil Sethi, Justice J P Singh directed deputy commissioner, Reasi, to permit the petitioners to join as NYC volunteers. "The deputy commissioner, Reasi, is directed to consider according permission to the petitioners to join as NYC volunteers, persuant to their selection as such, in case there was no legal impediment therefor," he said. The justice also ordered to list the case in the second week of October. NYC volunteers are initially entitled to get a monthly honorarium of Rs 2,500 per month, but after two years of the completion of their service, they are to get substantive appointment as physical education instructors, or teachers. For this purpose, they are required to support physical education activities, oversee the implementation of mid-day meal scheme in schools and help in the maintenance of school environment.
