HC quashes div com's order for detention of youth under NDPSA | | | EARLY TIMES REPORT JAMMU, Sep 6: Justice J P Singh of the state high court has quashed the November 23, 2009, order of divisional commissioner, Jammu, for detention of a youth under Narcotic Drugs and Psychotropic Substances Act (NDPSA). The court directive came today in a habeas corpus petition filed by Sheikh Nazir Hussain alias Imran, who was detained under NDPSA on November 23 last year on the orders of divisional commissioner, Jammu. As per the divisional commissioner's order, the detenue was alleged to be a notorious and habitual smuggler, who had developed a huge network of contacts and was part of the gang which was involved in the smuggling of charas from Kashmir to Gujarat and Ahmedabad. To prevent him from continuously indulging in the smuggling of charas from Kashmir to outside the state, NDPSA was slapped on him by the divisional commissioner. The detenue challenged the divisional commissioner's order by filing a habeas corpus petition in the court and making a prayer to investigate the right of the authorities to detain him. While allowing the habeas corpus petition, the court quashed the detention order issued by the divisional commissioner with the direction to set the petitioner free from preventive custody.
