Fireman cannot act as fireman driver: HC

JAMMU, Sept 7: The High Court today made observed that a fireman cannot act as a fireman driver. Justice Sunil Hali of Jammu & Kashmir High Court Jammu Wing after hearing . Advocate SS Lehar & Advocate Meharban Singh appearing for the petitioners and AAG Jagdish Parihar for the State observed that a candidate who applies for the post of fireman cannot perform the duties of fireman driver.
The specific stand taken by the respondents that the petitioner has not obtained marks which was obtained the last candidate of SC category. The further contention of the petitioner that there are still four posts available in the SC category is also misplaced. The respondents in there counter are specific to the extent that all 17 posts of fireman in SC category have been filled-up and there are only 3 posts of fireman driver left in the SC category which could not filled-up due to non-availability of eligible candidates. In view of the stand taken by respondents, no direction can be issued for considering the cases of the petitioner for the post of fireman driver for which he has not applied and dismissed the petition which is found to be without merit.
The petitioner Balbir Singh in which he submitted vide advertisement notice issued on May 22, 2006 by the respondents; applications were invited for the post of fireman/fireman drivers, the total numbers of posts which were advertised 314. Reservation Quote was also provided. The grievances of the petitioners that in 314 vacancies of Fireman/ fireman driver, the respondents could not have bifurcates the said vacancies and stated that out of these vacancies 26 were required to be filled from SC category. On the other hand the respondents submitted that out of 314 posts, 214 were meant for fireman and 100 posts were for fireman drivers. It is stated that both the posts are different so far as nature of job is concerned could not be clubbed together. Seventeen posts were reserved for SC category, so far as post of fireman driver, eight posts reserved under SC category. The petitioner participated in the selection process and was awarded 57.10 points whereas the last selected candidates in SC category obtained 63.40 points. It is thus stated that the petitioner having failed to make the grade and could not be selected for the fireman reserved category posts. (JNF)
