| Petition seeking release of pensionary benefits filed | | HC issues directions to Director Social Welfare | |
Jammu, October, 26- Justice Hakim Imtiyaz Hussain of J&K High Court Jammu wing in a petition filed by Om Parkash Sharma Rtd Tehsil Social Welfare Officer seeking release of pensionary benefits, has issued various directions to Director Social Welfare Department and directed him to personally look into the matter and call for the record pertaining to the petitioner’s retrial/pensionary benefits. He shall hold enquiry and find out how much amount is outstanding against the petitioner. While holding the enquiry, the Director shall associate the petitioner with it and he shall be provided every opportunity to explain his view- points. Court further directed that whole process shall be completed within a period of two months from the date of this copy is served upon the Director Social Welfare Department and Director shall submit a compliance report which shall from part of the proceedings. On completion of enquiry, it shall be responsibility of the Director Social Welfare Department to complete the case of the petitioner for grant of retrial benefits like gratuity, GP fund, leave encashment including arrears. Amount due shall be paid to the petitioner within a period of one month after completion of said enquiry. In case the Director fails to make payment of the pensionary benefits to the petitioner within said period, the petitioner shall be entitled to interest @ 12% on the due amount till its realization. If any amount is found outstanding against the petitioner, Director Social Welfare shall be free to take all steps available under the rules to recover the same from the petitioner, court ordered.
