HC dismissed two writs related to appointment of ReT | | | Early Times Report Jammu, Sept 10: Justice Sunil Hali of Jammu & Kashmir High Court Jammu Wing has decided two writ petitions involved controversy related to the appointment of ReT Teaching Guides as the facts and law point involved in these writ petitions are similar. Therefore the same are being disposed of by this common order. The petitioner applied for the post of ReT Teachers for Revenue Village Hartaryan, the case of the petitioner is that the selected candidate had never applied for the post of ReT for village Sunari. Justice Sunil Hali after hearing Adv Anil Khajuria appearing for the petitioners whereas AAG Gagan Basotra appearing for the State and Adv DS Thakur appearing for the private respondents observed that the controversy involved in this case is within very narrow compass. While scanning the advertisement notice it reveals that the posts were available for village hartaryan. There is no mention that the said posts were also notified for village Sunari. It is also admitted that prior to Division of Revenue Village Hartaryan, Sunari was a part of Revenue Village Hartaryan. Private respondents were admittedly misled by this fact and they applied for revenue village Hartaryan. Even though they admittedly are belonging to village Sunari where posts were advertised. This fact has been confirmed by the official respondents in their reply wherein it is contended that the selection has been made strictly in accordance with the merit and also in terms of ReT Scheme. It is also admitted that private respondents had better merit than the petitioners. With these observations Court dismissed both the writ petitions. JNF
