Murder accused acquitted | | | EARLY TIMES REPORT Jammu, Sept16: Third Additional Sessions Judge Jammu Pawan Dev Kotwal today acquitted Pawan Kumar alias Papa who was facing Trial in a murder case which took place on November 30, 2005. On December 1, 2005 information was received that body of lady namely Neelam Devi w/o Dewan Chand is lying a Nallah across Kuthad Tehsil Akhnoor, an enquiry u/s 174 CrPC was initiated by the Police Post Chowki Chora. During enquiry son of the deceased Kishore Kumar deposed that accused Pawan Kumar has committed the murder of his mother by giving stick blows. On the basis of this statement police registered a case u/s 302/404 RPC and recovered the stick and Pandel of the deceased at the disclosure of the accused and after completion of the investigation challan was presented in Court of law. The court in the 27 pages judgment observed that Court is of the considered view that the evidence of deceased's son solitary eyewitness suffers from material discrepancies and has not been corroborated by any other direct or circumstantial evidence, therefore it is unsafe to rely on this witness to base conviction against the accused. The prosecution has failed to bring home guilt against the accused beyond all reasonable doubts as such challan is dismissed and accused is acquitted of the charges leveled against him and ordered that accused be set-free forthwith if not required in any other case. ---JNF |
