HC treats letter from Pakistan as habeas corpus petition | | | EARLY TIMES REPORT Jammu, Sept 21 : A letter written by Mohd Ajmal Malik r/o Mohalla Piplanwala Jang Pakistan to Chief Justice of J&K High Court has been treated as habeas corpus petition. The petitioner has stated that he has always appreciated Indian democracy and supremacy of judiciary. He has been informed by the international Red Cross that his son namely Abdul Hai Malik was arrested in 1996 and was awarded two years sentence. He is lodged in the Central Jail Hajari Bagh, Jharkhand, India. According to the petitioner his son has completed his sentence but has not been released till date. He further submitted that the TADA court has already ordered his release but the Govt of India is keeping him imprison unlawfully. The petitioner is more than 70 years of age and has not heard about his son for the last many months. He has urged the government of India to release his son. A copy of Letter from International Red Cross is also enclosed. The High Court treated this letter as habeas corpus petition and admitted it as well. The State Govt and Union of India are impleaded as respondents. Notices have been issued to State through Advocate General and Union of India for filling statements of fact. Status report regarding detention of the detenue Abdul Hai Malik also called from the Superintendent of Central Jail Hajari Bagh, Jharkhand. Justice JP Singh after hearing Sr. Advocate Sunil Sethi for the detenue and AAG Gagan Basotra appearing for the State and SS Chib CGSC for Union of India ordered that list this case in the next week until them the detenue be kept in central Jail Jammu, however with liberty to the respondents to produce the detenue in the Court where his presence was required.
