Charges framed against Pak trained ultra under EAO

Jammu, Sept 27: Principal Sessions Judge, Jammu, A.K. Shan has framed charges against one Ashiq Hussain, a Pak trained militant u/s 3 Enemy Agent Ordinance.
According to the police case, accused was arrested in the year of 2008 while he was coming from Batote at Bagu Nallah Check Post by ASI Manpreet Singh. Accused could not satisfy the said officer of his coming from Batote at the dead night .Whereupon suitcase being carried by the accused was searched from which one passport issued by the Ministry of Interior, Govt of Pakistan bearing photograph of the accused with his address as resident of Rawalpindi Pakistan, two identity cards issued by the Govt of Pakistan, air ticket issued by the Pakistan International Air Lines, Karachi Islamabad ,one card bearing words Welcome to Nepal and two SIM cards of U Phone were recovered . On enquiry, accused revealed his name with his address at Udheypura Khan of Mohalla Tehsil Handwara, District Kupwara .He further disclosed that in the year 2001 he had crossed over to Pakistan occupied Kashmir where he was trained in handling arms and ammunition and after completing his training , by using forged passport, he came to India via Nepal to act as an agent of enemy in spreading terrorism ,to kill citizens and to wage war against India. A case u/s 120-B, 121-A RPC and section 3 EAO was registered against the accused.
While framing charges against the accused Principal Sessions Judge, Jammu, AK Shan after hearing Public Prosecutor Shabir Ahmed appeared for the state and Adv Prince Khanna appeared for the accused observed that offence u/s 3 E.A.O. is concerned there are sufficient grounds for holding that accused had been in Pakistan with some ulterior motive and returned back to spread terrorism by acting an agent of enemy. The recoveries also satisfies the view of this court in coming to such conclusion, prima facie. Another factor which prima facie pointed out the involvement of the accused in the illegal activities on behalf of the enemies of this country is his arrest in the suspicious circumstances during the dead night in Batote which is about 150 kms. from his house. With these observations, Court framed charges u/s 3 Enemy Agent Ordinance against accused Ashiq Hussain. JNF
