Harsh blames NC-Congress coaliton for violating state constitution

Jammu,September 28:-Even though the ruling alliance has,for the time being,postponed the plan of adding four more faces in the council of ministers,headed by Omar Abdullah,its task in this direction may become difficult after the working chairman Panthers Party,Harsh Dev Singh,has stuffed his gun with sufficient ammunition to target the NC led coalition Government.His plan is to raise the issue,in the ensuing special session of the Assembly beginning in Srinagar from September 30,regarding,what he calls,violation of the state constitution by the ruling alliance.
Explaining it that by giving a backdoor entry to several favourites who have been appointed as vicechairmen of various boards,including the Kissan Advisory Board,Scheduled Caste and Scheduled Tribes Boards,Pahari advisory board and the women Commission the weak financial structure in Jammu and Kashmir has come under added burden because all These vicechairpersons enjoy the status of ministers of state.Besides this the Chief Minister has appointed adviser and political adviser to him.
Harsh said that when the Parliament adopted in 2006 a law limiting the size of the councl of ministers in the centre to 10 per cent of the total strength of the Lok Sabha this very law had been adopted by the state legislature with major modification.He said under section 38 of the state constitution the size of the ministry cannot exceed 25 because in Jammu and Kashmir the law limits the size of the ministry to 20 per cent of the strength of the Assembly and the Council>As such the size of the Ministry could not exceed 25.He said there are four vacancies in the ministry after G.M.Saroori was sacked but it would be added violation of the state constitution if the Chief Minister inducted four new faces in the council of ministers because he has already crossed the limit,imposed by the state constitution,by appointing more than six vicechairpersons of various boards and advisers.
The Panthers Party leader said whether in the centre or in Jammu and Kashmir the purpose of limiting the size of the ministry was to ensure that it did not cause any major drain on the state exchequer.He said that it is not only the pay and perks given to the chairpersons of various Boards and advisers but also the salaries and perks being drawn by a fleet of staff attached to them.
He wanted the Government to reduce the size of the ministry in case it wanted to accord ministerial status to chairpersons and advisers so that the internal resources of the state did not come under added strain.(eom)
