Murder accused gets life-imprisonment | | | Early Times Report Jammu, Sept 29: Principal Sessions Judge, Samba, Suresh Kumar Sharma today awarded life-imprisonment and fine Rs 5000 to accused Uttam Kumar Gosh, a BSF personnel, who committed the murder of his wife and newly born girl child. Principal Sessions Judge, Samba, Suresh Kumar Sharma after hearing Public Prosecutor Sukhdev Singh appearing for the state whereas Adv Subash Singh Sambyal appeared for the accused and accused was present in custody and also referred the various judgment of the Supreme Court and held that prosecution has succeeded in proving the charge against the accused beyond reasonable shadow of doubt for offence u/s 302/201 RPC, said that the accused being a person from belt force having firstly killed his wife by strangulating and his daughter by throttling and then he burnt them in a premeditated manner has committed heinous offence in brutal gruesome and diabolical manner. This would in normal circumstances warrant extreme sentence of death. But in this case , Court think the lesser punishment of life-imprisonment would be appropriate and proper in the interest of justice for the reason the instant case is based on circumstantial evidence. Secondly the accused after committing the offence returned to his unit on his own with brother-in-law and also made extra-judicial confession. Thirdly the accused is 44 years of age. With these observations, Court awarded life-imprisonment with fine Rs 5000 u/s 302 RPC and u/s 201 and also awarded rigorous imprisonment for two years and fine Rs 1000/- and ordered that sentences awarded shall run concurrently.
