Hearing in Delimitation for J&K starts in Supreme Court | Bhim Singh initiates Arguments for Delimitation | | Early Times Report JAMMU, Sept 29: Division Bench of Supreme Court of India comprising G.S. Singhvi and A.K. Ganguly started hearing of J&K National Panthers Party’s appeal for constituting Delimitation Commission in J&K for the assembly constituencies which have not been done by Govt. of J&K as Congress, NC and PDP had stood against it . The Panthers Party had filed appeal against the judgment of J&K High Court of dismissal. The Supreme Court started hearing. Bhim Singh who started arguments for J&K National Panthers Party submitted that the state of Jammu and Kashmir is the only province which has unlimited autonomy which is evident from the fact that Parliament of India has no power to legislate in respect of J&K. He being a senior attorney-at-law told the Court that the Parliament has abdicated its power to legislate even in respect of those subjects which were included in the Instrument of Accession by Maharaja Hari Singh. He said that only President of India can legislate on defence, communication and foreign affairs matters by issuing a Presidential Order with the concurrence or approval of the government of J&K. He said that J&K has a separate Constitution and therefore it has enacted a separate law for the Delimitation of the Assembly constituencies under Section 47 of the J&K Constitution. Bhim Singh submitted that National Conference government quickly copied the Central law and put a bar on the increase of assembly constituencies w.e.f. 2002 and further barred the Delimitation of the constituencies in the state. He told the court that if the present law made by National Conference is not abrogated, there shall be no reservation for the ST (Gujjars, Bakerwals and Gaddies) for 40 years and there shall be no rotation of the SC reserved seats for the 40 years which will create civil unrest and can result into dangerous social consequences. Bhim Singh shall continue his arguments tomorrow before the same court. The Union of India was represented by a Solicitor General, Gopal Subramaniam and Advocate-General, J&K state Qadri. Those advocates who assisted Bhim Singh included B.S. Billowria, Ritu Puri and Satish Vig.
