Disproportionate assests case: AEE gets one-yr imprisonment and fine Rs 50,000 | | | EARLY TIMES REPORT Jammu, Sept 30 (JNF):- Special Judge Anti-corruption, Jammu, A.K. Koul today awarded one year imprisonment and fine Rs 50,000, the then AEE Purshtom Kumar Kohli in a disproportionate assets case after year 14 years of investigation and trial. According to the VOJ case that source information was received which revealed that Purshtom Kumar Kohli, AEE Irrigation and Flood Control Department, Jammu had accumulated assets moveable and immovable which are not proportionate to his known source of income. This information led to secret enquiry to ascertain the truth and it was found that information was credible. Case under FIR NO 40/ 1996 was registered u/s 5(2) PC Act 2006 and started investigation. During the investigation, VOJ found that assets worth Rs 10, 99, 574/- disproportionate to his known source of income. After completion of investigation challan was presented in the Court. In the 45 pages judgment Special Judge Anticorruption, Jammu, AK Koul after hearing both sides and gone through the case and observed that the prosecution has through a long a drawn exercise established that accused was found to be in possession of assets disproportionate to his known source of income. Though the case of prosecution was that accused had disproportionate assets to the tune of Rs 10, 99, 574. 29 paisa, but during the Trial it could not be established that accused had disproportionate assets as projected by the Investigating Agency.. The accused has been proved to have disproportionate assets to the tune of Rs 3, 82, 429/-. The accused was not in a position to justify as to how he managed hug assets, which were not compatible to his income from legal sources. That as brings the act of the accused within the ambit of section 5(2) r/w 5(1) (e) of Prevention Of corruption Ac. The charge against the accused under public men and public servant declaration of assets and other provisions has not been brought home to him beyond all shadow of doubt. With these observations, the Court sentenced Purshtom Kumar Kohli, then AEE to imprisonment for a period of one year and a fine of Rs 50,000/-. Court also cancelled his bail and taken him in custody immediately and sent to him District Jail Jammu to serve the sentence. JNF
