HC allows State to complete selection process of SI | | | Early Times Report Jammu, Oct 1: In 13-writ petitions challenging the selection of Sub Inspector of police in four wings of state police Armed, executive, Auxiliary and Telecommunications which was stayed by the High Court, Justice JP Singh after hearing all the counsels has modified the interim orders issued by the High Court permitting the state respondents to complete the selection process against available vacancies of Sub Inspectors in J&K Police, reserving 37 vacancies in the respective categories against which the petitioners have applied. It has however, restrained them from finalising the selection of those who had appeared in the second entrance test and cleared the written test. Court further clarified that the selection and appointments made pursuant to this order shall, however, remained subject to the orders of the Court. In the petitions one of the questions which was canvassed at the Bar was as to whether or not the state respondent’s action in allowing those who had not participated in the endurance test in the first instance, who participate in the second endurance test, arranged for them permissible. It was projected on behalf of petitioners that the petitioner’s selection had been adversely affected because of the omission of the respondents to notify the numbers of existing vacancies against which the selection had to be made. Justice JP Singh after having considered the merit of the submissions of counsels for the parties observed that Court came to the conclusion that continuance of the interim orders issued in these petitions pending hearing of the petitions, may not be in public interest and in the fitness of the circumstances additionally, because of interest of the petitioners, in case they ultimately succeeded in their petitions can be appropriately protected by reserving the posts available in their respective categories against they which they had applied and restraining the state respondents from finalizing the selection of those who were given chance to appear in the second endurance test and were selected in the written test. With these observations, the Court modified the interim orders and permitted the state respondents to complete the selection process and fill-up of the available vacancies of Sub-Inspectors in J&K police in its four wings.
