Fictitious drawal of GP Fund | Court orders further investigation | | Early Times Report JAMMU, Oct 2: Third Additional Sessions Judge Jammu today in a case of misappropriation of GP fund to the tune of Rs 20, 200 of a retired police head constable ordered further investigation of the case. Third Additional Sessions Judge Jammu Pawan Dev Kotwal after hearing Additional Public Prosecutor (APP) G.S.Charak and accused along with counsel, allowed the application and directed SHO Incharge Police Station Pacca Danga to carry further investigation to find out whether the accused persons had forged signatures of complainant on the GP Fund payment register. Court further ordered for seizing and getting vouchers examined through chemical examiner. Investigation Officer (IO) has been asked to submit report. Court added that further investigation shall be completed within shortest possible time and report should be submitted within three months from the date of receipt of copy of this order. Court added that investgastion officer (IO) is at liberty to collect record from this Court. In the complaint, Bholu Ram had sought direction for reinvestigation/further investigation on the grounds that separate charge-sheet ought to have been presented by the Investigating Agency with respect to all the three withdrawals. Therefore, charge-sheet suffers from mis-joinder of charges. The offences have been added by police against the accused persons. There is misappropriation of withdrawal amount and used for forged requisition and claims. The requisitions and vouchers have not been traced and make part of the challan. Though the receipts of fictitious drawls have been proved by prosecution as not genuine but it has not been ascertained as to who received the payment as no material of the accused persons has been obtained and sent for forensic examination for comparison.
