Mr Omar accession of J-K to India was unconditional

Jammu, Oct 7: Chief Minister Omar Abdullah is distorting the history of accession of J-K to India in order to create confusion in the minds of the people of Kashmir to retain control over his communal constituency, which is shrinking and eroding very fast. This is a sinister design and New Delhi needs to counter it without losing a single moment. New Delhi needs to counter this motivated campaign all the more because the failed and isolated Chief Minister has misused his official position and converted the state legislature into a den of undesirable activities that have all the ingredients of negating all that New Delhi has done so far to integrate the state with the rest of the country.
It is a matter of grave concern that the state Congress has utterly failed to rein in the provocative and controversial Chief Minister and allowed him to say things no national party and no state worth its name would ever tolerate. The attitude of the state Congress to the Chief Minister is intriguing. It appears the state Congress has completely forgotten Jawaharlal Nehru, Indira Gandhi, Lal Bahadur Shastri and PV Narasimha Rao, who did all that they could do to check the fissiparous tendencies in the Kashmir Valley and carve out a vast Indian constituency in the separatist and restive Kashmir. It would be too much to say that the state Congress doesn't understand the implications of what the desperate, frustrated and tired Chief Minister has been saying in and outside the assembly for months now. It knows everything but it is not acting. One can only hope and pray that good sense would finally prevail and the state Congress would act against the erring Chief Minister and controvert the pernicious influence of his speeches and activities. In fact, time is running out and to mark time would be to help the Chief Minister to achieve what his grandfather couldn't. Things are deteriorating in Kashmir at an alarming speed. The nation just can't afford any carelessness on the part of the state Congress and New Delhi. They would be regarded as sinners if things in Kashmir further deteriorate.
Why should the Chief Minister, who is constitutionally bound to defend the unity and integrity of India and respect and implement the Indian Constitution in its entirety, be reined in? He should be reined in on several counts. One of the immediate reasons is the speech he delivered in the Legislative Assembly on Wednesday while concluding the two-day debate on the situation in Kashmir. His speech was nothing but a blistering attack on New Delhi. He distorted the history of accession of J-K to India, spoke a white lie and told the Assembly: "Kashmir is an outstanding issue requiring a political solution…A dialogue process to address the external and internal dimensions needs to be started to resolve the matter…Jammu and Kashmir acceded to the Union under an agreement for which a special provision was made in the Constitution of the country…The accession of Jammu and Kashmir has taken place with India but the State has not merged with the country. 'It cannot be placed at par with Hyderabad or Junagarh.' The accession of Jammu and Kashmir to India has occurred under an agreement. We have not broken that agreement nor we have taken it back but you have gradually demolished it and people are aggrieved and angry for your this act. We both were required to uphold and respect the agreement. Many say that much water has flown down the Jhelum since then. We also agree, but it is still a fact that Jammu and Kashmir's accession to India is under an agreement and it is not the merger. For this reason special provision has been made in the Constitution of India."
Even a casual glance at his speech would make even a naive reach a definite conclusion in no time that the National Conference has no love lost for India, that it is hiding facts, that it considers the Indian J-K as a disputed territory and that it is speaking the language of Pakistan. The Chief Minister says, "Jammu and Kashmir acceded to the Union under an agreement for which a special provision was made in the Constitution of the country." Where is that agreement? There exists no such agreement as there exists no "Delhi agreement." It is a white lie. It is all communally motivated and Pakistani-inspired propaganda. It is an attempt at reopening the whole issue of accession. It is designed to disintegrate India and achieve separation and nothing else. It is shocking that none of the legislators asked the Chief Minister to place on the floor of the assembly the copy of the agreement signed at the time of accession the Chief Minister talked about. They should have asked him to do so, but they failed. The assembly session is still on. The legislators belonging to the Congress, the BJP and the Panthers Party must ask the Chief Minister to place on the floor of the assembly in the ongoing assembly session a copy of the agreement reached between Jawaharlal Nehru or any other Indian leader and the National Conference leaders.
It needs to be underlined that the Union Government had not made any promise at the time of the accession of J-K to India. It was unconditional and as per the constitutional law on the subject. It was in accordance with the rules under which all other princely states acceded to either India or Pakistan. It's true that the then Prime Minister of India Nehru did hold out a promise that the opinion of the people of J-K would be ascertained on the accession issue. But it was conditional. The condition was that Pakistan would vacate the aggression, Indian forces would go to the occupied territories (PoK and Gilgit-Baltistan) to maintain law and order and once law and order was established, plebiscite would be organized in the whole of the state as it existed on August 15, 1947. The plebiscite was to be organized in the whole of the state and not district-wise or province- wise. The condition was never fulfilled by Pakistan. Instead, Islamabad ceded over 5,000 Sq miles on the state territories in the Gilgit-Baltistan region to China.
Similarly, there is nothing on record that could even remotely suggest that Nehru or any other Indian leader had made any commitment with the National Conference leaders that the constitutional framework for the state would be in accordance with the views of the Valley-based National Conference. There is also nothing on record that shows that the National Conference leaders, including Sheikh Abdullah, had asked New Delhi at the time of accession to give a special status to J-K. In fact, the National Conference leaders had no locus standi in the matter. It was the Maharaja of J-K who alone had the power to take a decision on the political future of the state. It is a different story that Nehru transferred the political power from Jammu to Sheikh Abdullah, who was yearning for power and who tendered an unconditional apology in writing to get out of the jail.
