HC rejects bail application of SI | | | EARLY TIMES REPORT JAMMU, Oct 8: Justice Sunil Hali of the state high court today dismissed the bail application of Sub-Inspector (SI) Satnam Singh, who was investigating officer (IO) in the much publicized Amandeep Singh murder case. SSP Manohar Singh and contractor Nagar Singh alias Nago were also arrested in the murder case along with other accused and jailed.Satnam, who was IO in the case, is facing trial under sections 409, 120-B, 201 and 34 of RPC read with section 3/25 of the Arms Act. He had filed an application for grant of bail before the trial court, which was dismissed. After hearing advocates for the petitioner and the state, Justice Hali observed that the court had earlier also disposed off the bail applications of other accused facing trial in the case. He said petitioner was stated to be part of the conspiracy of fudging of weapon of offence along with other police officials. He was part of the conspiracy hatched by Nago and other police officials. While rejecting the bail application of Nagar Singh and Rakesh Singh, court had observed that the circumstances which had been brought into focus by the respondents regarding the conduct of the accused and their capacity to influence the course of trial was linked to the fact that they had managed the then investigating agency headed by the district police head. It was further contended that the conduct of the accused in not surrendering before the investigating agency was another circumstance which weighed against them. While dismissing Satnam's bail application, Justice Hali observed that the petitioner, who was working as a SIat Gandhi Nagar police stationr, fell in the said category. The observations of the court that Nago and Rakesh Singh had managed to influence the then district police chief, heading the earlier investigating agency, and also other police officials in swapping the original weapon of offence as alleged by the prosecution, was an issue which had wider ramifications on the society as a whole. Having said so, court finds no ground to grant bail to the petitioner. The application is, accordingly, dismissed. However, petitioner would be at liberty to file a fresh bail application after the statement of key eye witnesses is recorded.
