Court denies bail to Heroine Smuggler | | | EARLY TIMES REPORT Jammu, October-09 (JNF):- Principal Sessions Judge Jammu AK Shan has dismissed the bail application filed by the accused Mohd Irfan r/o Village Sulballa Gool, District Ramban who is facing trial in a NDPS Act. As per the police that on March 8, 2010 police were carrying out checking of vehicles at City Farm, National Highway, by pass, Greater Kailash, Jammu when at about 5 PM accused crossed the checking point. He was stopped and on search it was noticed that he was carrying a polythene envelop concealed under his armpit. Same was found to contain heroine like substance which on weight turned out 680 gms. The accused was arrested and request for registration of case was made whereupon FIR for the commission of above captioned offences came to be registered in the concerned police station. The court after hearing Adv PNocate Goja for the petitioner whereas Public Prosecutor Shabir Ahmed appearing for the state and referred the various judgments Supreme Court and High Court of J&K and observed that in the present case, if, at this stage, it is believed that the accused are not guilty of the offences by taking into the account the discrepancies in the evidence on record that would conclude the trial, which, according to Court is not permissible and dismissed the bail application filed by the accused.
