In 1947 , 1953, 1975, 2006 it was Congress and in 2010 it is again Congress at Delhi. | A Look Through the Mist | Daya Sagar | 10/9/2010 9:50:42 PM |
| Those who have been making opinions on J&K in the past have miserably made New Delhi to fail in handling the J&K affairs. The advisors on Jammu and Kashmir affairs need be changed. New Delhi must acknowledge , before it is too late, that Jammu and Kashmir is not only Kashmir Valley. Approach held so far has weakened the social and nationalistic ties made through the 1947 Accession of J&K with Indian Dominion.. Even some nationalist Kashmiri leaders are feeling neglected and say that it is better to question the intentions of GOI for attracting attention. Now the people of J&K too will have to work hard to come out of the clutches of the power hungry local leadership... Omar Abdullah has said on the floor of the JK Legislative Assembly on 6th October ::: "It cannot be placed at par with Hyderabad or Junagarh. The accession of Jammu and Kashmir to India has occurred under an agreement. We have not broken that agreement nor we have taken it back but you have gradually demolished it and people are aggrieved and angry for your this act. We both were required to uphold and respect the agreement. Many say that much water has flown down the Jhelum since then. We also agree, but it is still a fact that Jammu and Kashmir's accession to India is under an agreement and it is not the merger. For this reason special provision has been made in the Constitution of India. When we talk of autonomy we are talking of granting it under the Indian Constitution", he maintained and said, "we are not breaking Jammu and Kashmir from the rest of the country but demanding solution under the constitution of India. Sheikh-Indira accord, the accord between Rajiv-Farooq and the autonomy resolution passed by the State Assembly are all political discourses under the constitution to address K-issue. People say, if this is not carried forward where lies then seriousness towards this issue. This is the thinking of my party, my allies in the Government has not stamped this ideology. They have their own thinking about the issue"…., Omar has said enough. It was for New Delhi to reply to his quarries and allegations. The agreements / and commitments he had named mostly pertained to Jawahar Lal and Congress. Now also it is Congress in alliance with him as well as is at Delhi. But no clear and specific reply clearing the allegations as well doubts in the minds of Omar Abdullah has come till date. May be Congress leaders at Delhi either do not have reply or to them what happened in JK Assembly is not that important for them. But surely the messages that emerged from JK Assembly on 6th Oct have added to the negative questions in the minds of new generations as regards the status of JK ‘s accession with India. What Omar has said in Assembly has even shadowed the daring speech of Dr. Farooq Abdullah as was made on the floor of Parliament on 26 August this year. Surely Dr. Farooq too would have been hurt even more than he was hurt after he did not receive any response from the Indian Parliamentarians whom he had questioned for their silence over 22 February 1994 resolution of Parliament of India as regards freeing the POK areas from Pakistan. In the past also Delhi did not take Kashmir affairs that seriously in 1946, 1947, 1953 and 1975. So, those who questioned the 1947 Accession have been getting enough grounds to play. In 1941 J&K National Conference { before 11/6/1939 Muslim Conference } joined All India States Peoples Conference .National Conference celebrated 23 rd August 1942 KASHMIR National day { not Jammu and Kashmir National day }. The British Cabinet Mission on India presented a memorandum on 12-05-1946 to Chanacellor of Chamber of Princes in India ( Nabab of Bhopal) where in the future of Princes was also defined and suggested; with the lapse of parmountcy on 15-08-1947, the Princes were free to accede to either dominion ; defence obligation of British was to also lapse . Sheikh Mohd Abdullah knew that the question of application of two national theory based on religion did not have any lawful sanctity as regards a Princely State like J&K.. He had expressed his thinking clearly in 1946 { but strangely Jawahar Lal Nehru could not under stand , no sane mind would accept} when he called for Quit Kashmir movement against the Maharaja interpreting the Kashmir agreement ,that the East India Company had entered with Maharaja Gulab Singh in 1846, in his own way.. He wanted the Maharaja Hari Singh to also surrender his rights over Kashmir “Valley” with the retreat of British on 14-08-1947 and transfer of power to National Conference in Kashmir as it was to be for Congress in India. Otherwise in routine tables would not turned towards Sheikh Abdullaha since he did not have much influence Jammu Province and also had Muslim Conference to oppose in valley. Jawahar Lal Nehru supported quit Kashmir call.. Maharaja did not agree for conceding to Quit Kashmir theory of Abdullah since demand was also against the draft policy of All India State Peoples Conference as regards the local governance { immediately after accession / independence} in the Princely States of British India. Maharaja’s government arrested Sheikh Abdullah on 20-05-1946. In June 1946 Nehru decided to visit Kashmir to defend Sheikh’s case and was arrested at Kohala Bridge. Abdullah was sentenced to three years rigorous imprisonment in July 1946 for sedition and was released { under the pressure from Nehru} in September 1947 after he pledged trueness to the Maharaja. Later { strangely} Nehru and Mountbatten combine made the acceptance of Accession look like a conditional one. This way Nehru provided a written document { though its authority could be contested} to the anti India elements for use at local as well as international levels. Nehru failed to completely motivate Sheikh Mohd Abdullah politically even after Hari Singh appointed him Prime Minister in 1948. Nehru had fallen flat before Sheikhs desires , and ultimately even Sardar Patel could not stand before the pressure of favours that Nehru carried for Sheikh Abdullah and Maharaja Hari Singh was made to quit the State in June 1949 permanently. Jawahar Lal Nehru had made a criminal mockery of the 1947 Accession of JK with India, but Indian people have not that seriously questioned Nehru or his Heir Apparent. Rather it has been the Indian leadership that has helped Pakistan to make a mockery of the lawful accession of the Jammu & Kashmir .Sheikh’s ambitions later became problem for Nehru.. In an interview to Michael Davidson of Sunday Observer in May 1949 Abdullah was reported to have said “ we want to live in friendship with both the Dominions ( India & Pakistan)”. Sheikh Abdullah is quoted on 25-03-1952 that in case the Constituent Assembly of J&K does not ratify the 1947 Accession of J&K with India no one should infer that Kashmir will become part of Pakistan .Right since 1946 J&K affairs had been mishandled by Jawahar Lal Nehru. Sheikh Mohd Abdullah in a speech at R. S. Pura on 10 -04 -1952 questioned the status of J&K in relation to India. Only then it alarmed Jawahar Lal Nehru , but it was late.. Sheikh’s utterances had resulted in the August 8th 1953 dismissal of Sheikh Abdullah as Prime Minister of J&K by Yuvraj Karan Singh ( Regent), elected Sadare- e -Riyasat of J&K. The Congress leadership and Government at Delhi made a mess of the arrest of Sheikh Abdullah when Congress stepped out of power infavour of Sheikh Abdullah in 1975. It was duty of Congress to tell the people of JK { Kashmir Valley in particular }. the reasons for arrest of Sheikh in 1953 and honourable acquittal in 1975.. But Congress did not do so Rather Congress / New Delhi allowed doubts to live. Mufti Mohamad Sayeed Ex J&K CM on 16 September 2006 talked of SELF RULE in a public meeting at village Sayee in R. S. Pura area of Jammu. Mufti’s Self Rule did talk of joint control of India and Pakistan on some affairs of Jammu and Kashmir. How did it fall with in the purview of 1947 accession of JK with India could be any body’s guess. Even persons Farooq Abdullah must have been disappointed with the manner in which New Delhi has handled the unbridled terrorism / separatist ideologies originating from Pakistan and Pakistan Occupied parts of J&K as well as local separatists. But for Congress there was nothing bad in it and Congress shared power with Mufti in JK.. Mufti has attempted to compare his SELF RULE with some thing like Dr. Farooq’s “Greater Autonomy” to save his being called a anti India element. No Indian Prime Minister has asked Pakistan to vacate POK { 22 Feb 1994 Parliament Resolution} when ever they met. Instead Any action against Mufti in 2006 would have dethroned Gulam Nabi Azad Government that Congress got to dine on JK power tables after 30 years. And now it is Omar Abdullah who has humiliated India Government at Delhi { with Congress again in power seat } so badly on 06 Oct 2010. Farooq Abdullah has always described his self as First Indian. Surely the way some of his party men and his son { Chief Minister } opining on sensitive affairs Farooq Abdullah too must be very much disturbed. It is being alleged that it is Congress that forced him to make Omar as Chief Minister of JK so that the political ambitions of Congress could get some life. Congress knew that Dr.Farooq would be tough on separatists { he did advise in August this year a separatist leader to go to Pakistan in case India does not suit him} as well as political ambitions of Congress. Unless Omar Abdullah explains his conduct regarding 1947 accession very truly , after 6 Oct to any conscious thinking mind from international arena there would appear no difference between Omar Abdullah and Moulvi Omar Farooq as far as questions raised on 1947 Accession of J&K are concerned..Indian leadership must shed their un concernedness towards National issues atleast now. No doubt hard measures need be taken but it will not be that simple as it was a few decades ago. And in case Delhi still does not take the challenges thrown to 1947 accession seriously, miseries of nationalist elements in JK would grow. How long any one can afford to make the security forces fight militancy and antinational forces with tied hands and triggers locked. It is time for Farooq Abdullah also to come forward to establish what he said on 26 August in Parliament. It is only after 2 days that Congress spokesman broke the silence.. “Since 1947 till now Congress has always been firm that the state is an integral party of India and will remain so,” party spokesperson Manish Tewari told reporters at Delhi on 8 Oct. How seriously Congress has taken the affairs could be any body’s guess. (*Daya Sagar is social activist and leading scribe on Kashmir affairs [email protected])
