Amandeep murder: State directed to file objection in bail filed by former SSP

Jammu, Oct 11: In a petition filed by former SSP Manohar Singh presently lodged in Central Jail, Kot-Bhalwal, Jammu seeking bail on various grounds in FIR No 247/2009 and submitted that petitioner was arrested on September 27, 2009 on the basis of false and frivolous allegations along with other accused persons entering into a criminal conspiracy for causing disappearance of the weapon offence and about swapping of the same by another weapon.
Since the day of arrest the petitioner is in custody, during investigation, he remained in police custody and thereafter in judicial lock-up continuously. Besides this, a separate false and frivolous FIR No 275/2009 for the offence u/s 161/165-A RPC r/w section 5(2) PC Act 2006 also came to be registered against the petitioner and some other co-accused in the FIR No 247/2009.
In the petition, it has been alleged that later on when the SIT came to know or were legally advised illegal action for keeping the petitioner under illegal confinement which amounts to an offence and also punishable under the eyes of law then further added the offences like 409 RPC and 3/25 Arms Act to escape the criminal liability. It is also pertinent to mentioned that the alleged offences cannot be mixed with the challan u/s 302 RPC based on FIR 247/2009. The allegations leveled against the petitioner are altogether different and are based on false and frivolous information for which NO fir has been registered separately and straight way investigation was started by the SIT. Non registering of separate FIR alleged offences have caused a serious pre-judice to the petitioner as intention of the investigating agency is not clean and fair.
Justice Hakim Imtiyaz Hussain today after hearing all counsels issued notice to respondents, notices was accepted by Sr. Adv Sunil Sethi appearing for the respondents and directed to file objections within two weeks and list thereafter. JNF
