| HC came to rescue of petitioners seeking regularization in Agri dept | | | EARLY TIMES REPORT
JAMMU, Oct 11 : Justice Sunil Hali of J&K High Court Jammu Wing has directed the respondent state to consider the case of the petitioners for regularization against the post of Subject Matter Specialist in relaxation of recruitment rules by exercising power under Rule 9 of the Rules of 1988 within two months from the date a copy of this order is served upon the respondents. It is further directed to regularize the service of the petitioners as subject matter specialist retrospectively with effect from April 20, 1988.
The petitioners on the basis of their qualification MSC was adjusted against the post of Subject Matter Specialist in the Agriculture Dept, they were getting charge allowance and were continued on the posts and filed this petition seeking regularization on the post of subject matter Specialist.
Justice Sunil Hali after hearing Adv Rahul Pant appearing for the petitioners and Deputy AG RS Jamwal appearing for the respondents observed that Court was told at the Bar that even as on date the petitioners are continuing as subject matter specialists for the last more than 20 years and getting charge allowance in terms of the Rules of J&K CSR which fact is not denied by the respondents and with these observations Court allowed the petitioner and directed the respondents to regularize the services of the petitioners as Subject Matter Specialist retrospectively with effect from April 20, 1988.
