| Pakistan and its tutored lobby working in Kashmir valley are harping on plebiscite or right for self determination to the people of the state. We are at a loss to understand on what basis the issue of plebiscite is raised by these Pak supported leaders. It is not a simple demand; it is a dangerous for the whole of the country which affects Indian nation directly. It is unfortunate to play with the fate of Indian nation for its reshaping under the influence of Pak-campaign to shatter India in to pieces which is a great challenge for the existence of India. It is not possible for the Government of India to review the historical Treaty of Lahore and Amritsar made between Maharaja Ranjit Singh and British Government on 9th and 16th March 1846 respectively for reshaping the Indian nation. The partition of British India for Hindus and Muslims was the decision for ever lasting peace and not for opening the door for multiplying their further religion-based demands. It was the historical unique generosity that the status of nation for alien Muslims who had been struggling since their capturing political power for ruling India ws granted by the indigenous people of British India. Their greed for expanding more political power should have stopped from their legal limit in accordance with the Indian Independence Act of 1047; but immediate after the partition, Pakistan committed a bloody aggression on India to encroach upon the State of Jammu & Kashmir and Afridis of tribal area along with its regular army entered the State by violating international law and breach of trust, who started killings, plundering, rapes and bloodshed and destroyed green fields of village after village, rapid advance was continued by committing violence and killings, who so ever happened before them. This chaotic and horrific bloody situation had made the Maharaja helpless and nerves who prayed India to save his State and subjects from the raiders pushed by Pakistan..
Pak-invasion committed under the guise of tribal people with active ruling leadership of Liaqat Ali and Iskander Mirza which was a political folly as well as a big blunder that changed the future fate of the State for ever. The bloody aggression left no alternative to the Maharaja except to accede with India to survive and check the massacres, loot, heinous crimes, rapes and bloodshed as well as save the boundaries of his State. Had the Pak-ruling leadership not been violated the Stand-still agreement, and took patience, waited and watched the situation, the history of State would have entirely different, but its impatience spoiled the State future prospects for ever. Although His Highness the Maharaja Jammu & Kashmir did not open his mind on this very issue, but his working and action have had deduced that if his line of action would have been regarded and not made haste and hurry, the political situation would have been different; but instead of this, Pakistan started a misleading propaganda by ignoring the facts of the events deliberately. It infused the wrong notion among the world that the people of the State were waging a war for the right for self-determination as well as against the human rights violations committed by the Indian forces. In continuation of its mythical propaganda, the Indian Government and its forces were maligned and tarnished its image in the world. Pakistan made misleading propaganda to justified its stand, that under the situation it was bound morally and politically to support their movement started by the Kashmiri Muslims. Simultaneously, it continued rapid advance march and occupied the some part of the Indian State, but India would have not wished to spill human blood of those with whom they had lived closely for centuries vide its age old traditions, and it submitted a representation to the UNO regarding Pak-Aggression, which directed Pakistan through its resolutions to vacate illegally occupied Indian State territory in favour of India, stop bloodshed, withdraw tribal raiders and all of its forces from the occupied Indian State territory for the process of plebiscite, but it did not pay any heed and ignored its directives. In the meanwhile, it changed political, social and geographical position of the occupied territory and altered the status quo according to its desire. With the result of this, the UN resolutions lost its relevance as well as essence under new political change altered by Pakistan. Afterwards, it took abortive attempt to wage a conventional wars against India to encroach upon the State and committed heinous crimes and spilled human blood. In the horrific wars, Pakistan suffered a heavy loss. This defeat prevailed a good sense to ruling elites of Pakistan to come to the terms of negotiations in peaceful manner. It was decided to resolve all pending differences and issues peacefully on merit bases with out any third party mediation under Simla agreement, but it did not stick to its commitment and again under Lahore declaration it was decided to resolve all issues peacefully, but all the time it avoided and ignored to match its assurances in action and commitments made with India. Pakistan and its lobby working in the State as well as other Muslim world with out knowing facts are interested for granting outdated and conditional right for self-determination to the people of the State. The fact is that under Simla agreement and Lahore declaration, these two countries- India and Pakistan had decided to resolve all issues confronted to them under these agreements peacefully with out the influence of any out side third party i.e. to solve all outstanding problems bilaterally wherein Zulfikar Ali Bhutto had acknowledged vide Simla agreement that plebiscite for resolving the Kashmir issue was no longer a practical proposition in the light of discussion in Simla summit wherein leaving aside Aziz Ahmed had interrupted and proposed for plebiscite proposal which was categorically rejected by the Principal secretary to Indira Gandhi in the summit. Then Bhutto had opted for a final settlement of the State under Simla agreement for durable peace and normalization of relations between the two countries. The present Pak-ruling leadership is totally ignorant and unaware of the circumstances of the events and the conditions required for the UN resolutions which cannot be restored now. Failure after failure from its violent clandestine strategies, Pakistan afterwards by putting its guns on the Hurriyat shoulders fired a plebiscite salvo to agitate its demand to alienate from India with separate identity which was not obligatory on the part of India in view of the time-barred dead issue and violations one after other as well as the Universal Declaration of Human Rights of the UNO. In case the Pak-proposal is processed for the people of FATA, Balochistan, Frontier, and Sindh provinces where their revolt has challenged Pak- integrity which has pushed it on the brink of its break, it would be suicidal for it. Thus it is clear that the demand for plebiscite neither can be agitated to dismember the country nor religion can be taken as the base for that demand. To make unilateral gross political alteration in the status quo of PoK was the serious violations of the UN resolutions on Kashmir issue. The European Union Foreign Affairs Committee released a document titled Kashmir Present Situation and Future Prospects headed by Baroners Emma Nichalson for the information of the statesmen and the ruling leaders of the world countries wherein she had depicted the real picture of Pak-diplomacy for which Pak-ruling leaders had expressed their resentment and tried to black it out. In the document there was a main thrust about the denial of democratic rights in PoK. Any plebiscite would be meaningless with out a change in policy from Pakistan, which claimed its right over the State. It is necessary to restore its status quo first before agitating any demand vide UN resolutions, with out the withdrawal of Pak-troops as well as the return of Punjabi and Pathan settlers from Gilgit and Baltistan and surrendering the State territory given to China and other violations in altering the status quo, no heed will be paid to their demand. The change of demographic character which threatened indigenous people is a serious issue for which Pakistan is answerable. The European Union Committee noted with glaring difference between India and Pakistan with the comments that the Republic of India was the largest secular democracy in the world and evolved democratic structures at all levels, whereas the Islamic Republic of Pakistan still lack implementation of democracy in its country and yet had to start the process of democracy in Gilgit Agency. On the nuclear issue it informed to the world through its document that the nuclear doctrine of India rested on the principle of No First Use. Apart from it, its other observation was that Pakistan had consistently failed to fulfill its obligations to introduce meaningful and representative democratic structures in the State’s part under its command. This document placed the facts before the world community to gauge the gravity of the Pak-Government that how it misleaded the world for showing its mythical popularity of good governing The political ruling leadership of India lambasted Pakistan that its Government would not tolerate any nonsense talk about Kashmir. It ruled out possibility for any parlays in the situation while on one hand exciting hatred, false and baseless misleading propaganda on Kashmir is drummed up and on the other they sought to dictate terms according to its desire. India told that it was for peace, cordiality and friendship with Pakistan, but Pak-rulers could not have dictated any terms and conditions according to its whimsical desire to it. India further emphasized the fact that it was Pakistan which continued cross border terrorism that thwarted India’s legitimate efforts for reconciliation with Pakistan. The former Prime Minister Vajpayee declared on 20th November 2001 that since India and Pakistan were committed to adhering to bilateral dialogue under Simla agreement and Lahore Declaration, any reference to the UN resolutions on Kashmir was irrelevant, meaningless and absurd. He did not attach any importance to Pak-dictator Gen. Musharraf’s demand to resolve Kashmir issue according to UN resolutions. He refuted the charges levelled by the Pak-dictator that Pakistan had continued to abet cross border terrorism in the State found forceful expression at a time when Foreign Office, India had received reports revealing that US officials had accepted that Gen. Musharraf insistence that “Kashmir is an indigenous movement and the terrorist there are the freedom fighters look interestingly spurious”.
Apart from bringing to the fore the rejection by the UN and the US of the demand for a plebiscite in the State, these reports also revealed that there was a growing sense in Washington that Pakistan had gravely damaged in Kashmir and Afghanistan. Interestingly, one of the reports revealed that the US now understood Pak’s perfidious game in Kashmir and the connection between Afghanistan and Kashmir, besides the Policy Planning Staff of the US Department had rejected the doctrine of plebiscite or right for self-determination and said there had to be non-secessionist solution to the problem, as such US State Department through Stetinberg expressed that plebiscite was no panacea to Kashmir problem.
