Bail granted to CAPD storekeeper in misappropriation case | | | EARLY TIMES REPORT JAMMU, October-14 (JNF):- Special Judge Anticorruption, Jammu, AK Koul granted bail to Babu Ram, the then Store-Keeper CAPD store, Udhampur, who was booked on the written complaint of Director CAPD, Jammu and was arrested by Crime Branch on September 30. Granting bail to the store-keeper, Special Judge Anticorruption, Jammu, A.K. Koul after hearing both sides and referred the argument of counsel for the accused in which he urged that the magnitude of the scam, which has been projected by the IO suggested the involvement of the higher officers because petitioner being simply a class IV employee and was used as pawn to manage fraud through him. He has contended that petitioner in view of his official position cannot managed to misappropriate the stocks to the tune of around Rs 65 lacs and the agony is that none other than the petitioner has been booked in the case. Court after considering the facts of the case and arguments of both the sides observed that the fair conclusion that can be drawn from all but has been said is that the prosecution has not been able to make out a case for declining bail to the petitioner. With these observations, Court allowed the bail application of the petitioner and directed to release the petitioner from custody provided he furnishes bail bond to the tune of Rs 50,000 and two surety bonds in the like amount.
