HC directs Director Health Services Kashmir to appear in person

JAMMU, Oct 20: Justice JP Singh of Jammu & Kashmir High Court (Jammu Wing) in a contempt petition filed by a retired employee of the health department, has directed Dr. Mohd Amin Wani Director Health Services Kashmir to appear in person and show cause as to why he be not punished for committing willful disobedience of the directions issued by the Court.
In the contempt petition it has been submitted that the respondent Director Health Services Kashmir willfully disobeying the directions passed in the petition dated January 1, 2010 in which the Court directed the respondents to release assumptive pension and report compliance. It is also submitted that on January 1, 2010 the petition was finally disposed of with a directions to the respondent to personally look into the matter and process the case of the petitioner for grant of pension and other benefits. It was also submitted in the petition that by way interim relief the respondents shall pay Rs 2 lacs to the petitioner within a period of 15 days from today which shall be adjustable after pension and other retrial benefits gets finalized.
The court after hearing both the sides in contempt filed by Omkar Nath Bhan an employee of Health Dept Kashmir who was migrated in the year 1990 and retired in the month of November 1994, observed that warrants issued against the respondents were recalled on the assurance of Deputy AG Shaista Hakim that directions issued would be complied with within two weeks on or before October 15, 2010,in the event of the non-compliance of the directions had been directed to appear in person. Today neither the directions have been complied with nor is the respondent present in person. In these circumstances and on finding that the directions issued by the Court, have not been complied with, a notice issued to the respondent Director Health Services to appear in person and show cause as to why he be not punished for committing willful disobedience of the directions issued by the Court.
