CBI filed charge-sheet in much publicized Channi-Rama Land Scam

Jammu, July, 27 :-:- Central Bureau of Investigation (CBI) today filed charge-sheet in much publicized Channi-Rama Land Scam, which was registered on the direction of High Court in the Court of Chief Judicial Magistrate Jammu.



Chief Judicial Magistrate Jammu Mr. Sanjay Dhar after hearing KL Raina Additional Supt of CBI/ACB (IO) and Special Public Prosecutor Mr. SK Bhat appearing for the CBI, has accepted the charge-sheet for hearing and issued summon against Bush Chander for securing his presence in the Court on next date of hearing.



According to the charge-sheet this case was registered by the CBI on the direction passed by the High Court on February 4, 2005 while taking Suo-Moto action on disposal of writ ex-parte on misrepresentation of facts regarding service of notice on Jammu Development Authority and others. This writ petition was filed by four petitioners namely Devi Dayal Khajuria, Hari Hartar Singh, Vikas Sharma in which it has been pleaded that the petitioners were in possession of 6 Kanals of JDA land in Khasra No 328-min at Channi-Rama Jammu for many years, by virtue of correction in Khasra Girdawri, prayed to restrained the JDA from dispossessing them. The petition was decided by the Single Bench of the High Court Jammu wing on May 29, 2000 ex-parte and JDA/others restrained not to evict the petitioners from possession of from 6 Kanals and 10 Marlas of land without adopting due course of law. It was disclosed during the course of disposal of said writ petition that Devi Dayal Khajuria disowned his signature on the petition, affidavit and other documents and said that some one has misrepresented him by way of making his false signature. It was also revealed that the land in question was lying vacant and was in the possession of JDA, while transferring this case to CBI.



During the investigation conducted by CBI reveals that the land under survey Khasra No 328-min in Village Channi-Rama was in the form of abandoned jungle during the year 1990 and was being encouraged by villagers from time to time. It has been further revealed that Joginder Singh, Dalbir Singh, Kewal Singh and Dinesh Singh r/o nearby Channi-Rama village had shown their illegal possession on the 12 Kanals of land and getting necessary Girdawari entries made in Khasra Girdawari. They tried to dispose off the said illegally occupied land to Devi Dayal Khajuria for a sum of Rs 1, 50,000/- through Tilak Raj Sharma a property dealer, an advance amount of Rs 40,000/- was paid by Devi Dayal in 1993-94 at the time of handing over possession and the agreement was executed on may 2, 1997 between Devi Dayal Khajuria and Joginder Singh and three other occupants before the Notary and the relevant agreement was entered in the register of Notary. Investigation further reveals that Ram Singh Gupta the then Girdawar Channi-Rama has changed the entries regarding possession of JDA Land and the land mentioned under occupations in the names of Devi Dayal Khajuria 4 Kanal, Hari Hartar Singh 10 Marlas, Vikas Sharma 1 Kanal 10 land. Handwriting of late Ram Singh Gupta was confirmed by the handwriting expert Shimla.



When the JDA not allowing any construction of the said illegally occupied land, in view of this Devi Dayal Khajuria could not utilized the said land and took his hands off from the said land. But on the other hand Tilak Raj Sharma property dealer took over the control and it was he, who remained instrumental in filling the writ petition bearing No 643/1999 in the High Court Jammu wing for getting stay against any evacuation from JDA, the Tilak Raj Sharma prepared a petition on behalf of Devi Dayal Khajuria, Hari Hartar Singh, Vikas Sharma , Devi Dayal Khajuria was impersonated by his assistant Bush Chander, who signed as Devi Dayal Khajuria, whereas Tilak Raj Sharma himself impersonated for Vikas Sharma and signed the papers as Vikas Sharma. Hari Hartar Singh connived with Tilak Raj Sharma in the process of drafting/ filling the said writ petition in the High Court on the basis of these fictitious signatures. Signature of the another petitioner was taken on Vakalatnama in a deceitful way by Tilak Raj Sharma and Bush Chander by saying that his signature was required for settling some land dispute which was further confirmed by the witnesses.



CBI after completion of the investigation of the case has filed this Charge-Sheet in the Court of CJM against accused persons namely Tilak Raj Sharma, property dealer, Hari Hartar Singh and Bush Chander under section 120-B r/w 193, 199, 419, 420, 465, 466, 467 and 471 RPC, late Ram Singh Gupta, who made bogus entries in the revenue record has not put on trial as he died.
