HC sets aside advertisement notice

JAMMU, Oct 21: Justice Hakim Imtiyaz Hussain of J&K High Court (Jammu Wing) in a batch of petitions challenging the advertisement notice June 26, 2010 & corrigendum dated July 14, 2010 inviting applications for the post of Registrars/demonstrators in Govt Medical College Jammu has set-aside the said advertisement notice dated June 26, 2010 and directed the respondents to issue fresh notice in accordance with rules prescribed for the said posts within a period of one week from the date a copy of this order is served upon the respondents by the petitioner.
Dispute in these petitions relates to the eligibility clause in the advertisement notice issued by the Principal GMC Jammu and corrigendum to the said advertisement notice July 14, 2010 issued by Acting Principal GMC Jammu whereby applications have been invited for the posts of Registrar/Demonstrators in Govt Medical College Jammu on tenure basis for a period of three years in various disciplines from the in- service in J&K Medical (gazatted) Service Doctors, having one years experience as House Officers. The preference will be given to the candidates having post-graduate qualification in concerned discipline and having one years experience as house officer or equivalent recognized experience. In the corrigendum issued wherein it was notified that non-PSC doctors are also eligible to apply in terms of the advertisement notice.
The court after hearing Advocates Abhinav Sharma, GS Thakur, Ajaz Lone and Surinder Kour for the petitioners and deputy AG S Hakim and deputy AG RS Jamwal appeared observed that Court find the notice being not in accordance with the eligibility prescribed by the recruitment rule, the same cannot stand. Therefore, advertisement notice dated June 26, 2010 is set-aside with the direction to respondents to issue fresh advertisement notice in accordance with rules within a period of one week from the date a copy of this order is served upon the respondents by the petitioners and disposed of all the petitions along with connected CMP.
