RSS, VHP, BJP and allied organizations are getting ready to celebrate accession day. They call accession as full and final and J&K is integral part of India. Constitution of J&K also admit this assertion. At the same time separatist have seceded in last three months in internationalizing the Kashmir issue. It may be due to change in strategy of Pro-Pak, pro-freedom elements or due to approach adopted by state as well as by Centre government towards problem. Omar Abdullah make distinction between accession and merger. Centre government Ministers also endorse the same view, that may be union Home Minister P. Chidambram and Foreign Minister S.M. Krishna.
Both centre as well as state leaders fail to understand that accession was ratified by 75 elected members of constituent assembly except one member Abdul Goni, who opposed it. Hence accession was complete in all respect, even Sheikh Mohd. Abdullah agreed to it.
Maharaja Hari Singh signed Instrument of Accession on October 26, 1947. Accession includes the consent to acceed to India or a consent to merge with India. Infact in Round Table Conference Maharaja Hari Singh claimed that his state may be Muslim majority state but there is peace and communal harmony. The assertion and claim of Maharaja was a threat to the claim of "British Govt that Indian cannot rule". Muslim conference was flotted in Jammu & Kashmir. When in rest of the country Mahatma Gandhi gave a call for quit India. Jammu and Kashmir came forward with a call (quit Kashmir). Muslim Conference was changed to National Conference, as a matter of strategy but mind set remained the same.
A question mark was imposed by Lord Mount Batten on accession, according to which will of people was to be considered? Although, will of people in all states was nothing but will of Maharaja/ ruler of the state and this will was to be reflected by signing instrument of accession, either to merge to form India or Pakistan. 555 princely states have consented to merge with India and 7 with Pakistan.
In fact, Congress Working Committee have adopted resolution and accepted division of the country. Mahatma Gandhi did not opposed the same in true spirit. This division /partition of the country, was not accepted by common masses. That resulted into large scale blood shed on both sides. Rather the division was a political decision and not decision of a common man.
Another way to know the will of people was by way of refrandum under united nation charter and Pakistan was supposed to vacate the possession in PoK and have to withdrew the forces.
The power was also vested in UNO, when dispute was referred to UNO by Pandit Jawahar Lal Nehru. When attack was made on state of J&K by Qubalis, unilaterally cease-fire was announced. This matter came to rest during Simla agreement, when India and Pakistan made an agreement saying that it is bilateral dispute and both countries will resolve it with mutual understanding, without IIIrd party intervention.
In 1975 just before emergency, Sheikh Mohd. Abdullah came back in power by back door entry and Congress CM Mir Qasim was asked to resign to give way to veteran leader of Muslim Conference. It was common pressure on CM and from CM also that laws were extended in J&K without will of the public. A committee headed by D.D. Thakur was appointed and same submitted report that all laws are inorder and are in the interest of Jammu and Kashmir. We cannot understand J&K without referring to the sentiments of all three regions Jammu-Ladakh & Kashmir.
Jammu people fought on roads when students started agitation in 1979 demanding not to close Ayurvedic College and abolish interview system for Medical College selection. This was due to political interference in these institution and the same was done due to Kashmir centric approach.
Ultimately, this agitation failed. Student leaders including Author was arrested under PSA and citizen committee headed by Suraj Parkash Gupta (Adv.) and by Janata Party leader Prof. Chaman Lal Gupta entered into an agreement with Sheikh Mohd. Abdullah and called off the strike. Strike was also suspended by student leader as examination season was approaching.
Kashmir again attained focus when bloody proxy war backed by ISI started in valley in 1989. 4 lack Kashmir Hindus faced forced migration. Dr. Farooq Abdullah again captured the power. A phase of power in state was temporarily shifted to another family member G.M Shah who faced worth of public in 1986, when he declared few portion of Bua Ditta temple as Mosque. Hindu Raksha Samiti backed by RSS headed by author got success and an agreement was signed between R.K. Takkar Chief Secretary and author heading HRS on 23rd March 1986. Before this day Congress took decision and sacked the government of G.M. Shah.
Again Jammu and Kashmir faced another historical agitation in 2008 and Kashmir centric leadership was marganilized, even they were asked to vacate seats when delegation of Sangarsh Samiti met with Centre government delegation in Jammu.
Kashmir domination got upper edge after election of assembly in 2008 and Omar Abdullah was brought into power by Congress. It was a clear decision that Congress will support NC only if Omar Abdullah will be CM. National Conference got big blow as NC manifesto says that Dr. Farooq Abdullah have agreed to be CM and this election will be fought under his leadership.
Omar Abdullah worked as a spokesman of Kashmir speaking 27% people. A war of words started between Mehbooba Mufti and Omar Abdullah to become champion of Kashmir centric politics and policies. (Retd.) Justice Sagheer Ahmed again lit the fire of autonomy in his report. Self-Rule formula got set back alongwith RSS formula of total accession and complete merger. Foreign Minister S.M. Krishna endorsed stand of CM that accession was conditional temporary and it is not merger with India. Home Minister Advocated unique problem unique solution without understanding the consequences and ignoring the spirit of nationalistic forces in the state of Jammu and Kashmir..
Now, whether visit of Obama to India has imposed pre-condition of solution of J&K problem? What can be solution? Whether centre government is under pressure from American lobby.
We have entered into a critical phase by raising question mark, over accession. More power will be given to Kashmir after ignoring the legitimate rights of others. 8-point formula was just a interm relief . Now state will get more and more. Whether their can be division of state or more than division. This question is required to be answered by the authorities who have raised dispute over accession.
People are not ready to face another division of the country. Politician should realize, this mood and will of public. Now three member committee of Interlocutor is a step forward towards Kashmir Centric approach. Dileep Padgaonkar member of Ram Jathmalani’s Kashmir committee worked to implement 4-point anti-India formula of Pervez Musharraf and Radha Kumar favours self-rule with little bit of change.. Whether such committee can resolve the dispute and find a solution or will recommend more powers which will ultimately lead to another division of the country.
