| HC stays cancellation of Lecturer’s appointment | | | EARLY TIMES REPORT
JAMMU, Oct 22: Justice Sunil Hali of J&K High Court (Jammu Wing) has stayed the Govt order dated October 19, 2010 whereby cancelling the appointment of petitioner as Lecturer Gynea of GMC Srinagar.
Court after hearing Advocate Abhinav Sharma appearing for the petitioner issued notice to State of J&K through Principal Secretary Health & Medical Education Dept, Principal GMC Srinagar and HOD Gynecology returnable within four weeks. Counsel for the petitioner submitted that petitioner was appointed as lecturer Gynea in GMC Srinagar on December 31, 2009 on the basis of recommendations made by PSC. His selection was later on withdrawn vide communication dated October 8, 2010 issued by PSC, the Govt has issued impugned order on October 19, 2010 whereby cancelling the appointment petitioner submitted that this order has been issued without any notice to the petitioner. It is also submitted that after making recommendation for appointment, the Commission has become functus officio.
Court after considering the arguments of the counsel for the petitioner ordered that till next date of hearing impugned Govt order No 516-HME of 2010 dated October 19, 2010 shall remain stayed and petitioner shall be allowed to continue as Lecturer (Gynea) GMC Srinagar
