| HC dismisses KAS writ petition | | | EARLY TIMES REPORT Srinagar, Oct 22 : Jammu & Kashmir High Court on Friday dismissed a writ petition SWP No.1390/2010 and CMP No.2136/2010 filed by one Syed Shamim Rizvi In a judgment passed by Justice Mohd Yaqoob Mir, the Court observed that the petitioner having claimed in-service benefit in the KAS Main Examination 2009 did not make the grade. Also there were 1904 candidates in the order of merit in between the last candidate called for interview and the petitioner. “The petition in the given circumstances does not survive for further consideration, is dismissed as such”, the Court further observed. A M Magray Senior Additional Advocate General appeared on behalf of the J&K Public Service Commission before the Court with the plea that the candidate had applied against open merit category out of his own will and choice while applying for the KAS main examination 2009 and thus cannot claim to belong to in-service category. The Commission is also in the process of filing replies to other petitions pertaining to the KAS 2009.
