Details of Conditions for Plebiscite in Kashmir vide UN Resolutions. I

Aggressor Pakistan day in and day out harps on for plebiscite in Kashmir vide U N Resolutions to check the growing unrest among the Kashmiri Muslims as is presumed by it that it is the only recipe and for this purpose, it swift-footed campaign is organized to embarrass India by llevelling groundless charges for avoiding its commitments made internationally. In this regard, Pt. Nehru, at the very moment, refused the Pak-outburst during his speeches with the assertion that he would resign from his post if any commitments were made by him to international community, but Pakistan had been remained mum. No doubt that the Pakistan is helpless to forward its agenda on merit basis, because its every assertion is based on fictitious ground and white lie, as usual habit it first refuses later on admits that is its traditional habit. Now, it is misleading the world in the name of plebiscite for not implementing it by veiling the facts of the history. The chief points of mischievous propaganda made by it, anti-India agencies and Pak-supported press as well as the certain Governments in the world are that:
1. India agreed in 1948 for plebiscite to decide whether Kashmir should join India and Pakistan.
2. India agreed to demilitarize Kashmir and to allow a plebiscite to be held under the auspices of the United Nations.
3 India did some thing against the spirit of its international commitment when the Constituent Assembly of the State Jammu & Kashmir ratified accession and proclaimed that the state was irrevocable a part of the Indian Dominion.
4 India should go by two nations theory, Muslim majority State, it commands right to go with Pakistan for contiguity .
It is utmost necessary for the people of the world, especially should be familiar with the facts of the issue enabling to convince opponents to give justice for endorsing the ground facts. India, no doubt, under certain circumstances accepted to hold a plebiscite in 1948. It approached to U N as a sovereign country whose territory had been encroached upon through an act of most immoral kind of warfare. Its request was that the aggressor Pakistan be asked to take steps promptly for vacating the occupied territory peacefully.
The question of a plebiscite is based on the fact that India accepted the proposal in the U N resolution of August 1948, which first and fore most warranted that Pak-forces had no business to be in Kashmir and asked it to withdraw from the occupied State territory , which words are as under:
“ As the presence of troops of Pakistan in the territory of the State of Jammu & Kashmir constitutes a material change in the situation, since it was represented by the Government of Pakistan before the Security Council, the Government of Pakistan agrees to withdraw its troops from the State”.
This amounted to a confession by the Government of Pakistan under international pressure that it had lied to the Security Council in the first instance, that aggression had, indeed, been committed, and that it should be vacated. It was meant that India required fulfillment only after Pak-forces had been entirely removed from the every part of the territory of Kashmir. The U N Commission words are stated below that:
“When the Commission shall have notified the Government of India, that the tribes men and Pakistan nationals have withdrawn , thereby terminating the situation which represented by the Government of India.”
There was no reality on the part of government of India for any commitment to conduct any kind of plebiscite vides resolution which is self-explanatory and speaks itself for correct answer that:
Government of India and Government of Pakistan re-affirm their wish that the
future status of the State of Jammu & Kashmir shall be determined in accordance with the will of the people and so that end, upon acceptance of the truce agreement, both Governments agree to enter into consultations with the Commission to determinate fair and equitable conditions whereby such free expression will be assured”.
In the light of this, there was not any commitment to hold back the people of Kashmir from democratic expression of their will, if and when they deserted to do so. There was no commitment by the government of India that over the heads of the people of the Kashmir and over-braking all consequences to the people of India and the economic progress of Kashmir, a plebiscite would mechanically be held whenever Pakistan demanded one.
India commitment was to consult the Commission and clearly this commitment will not come into operation till aggression was not vacated entirely. It is an important for the international community to note in the serious manner impartially, that before going to plebiscite, the government of India would have to examine the qualified conditions requiring for it for having fair, free and congenial situation for determining the desire of the Kashmiri people. No plebiscite will be fair and genuine or free, if the people are asked to vote on the basis of Islam verses Hindu religion. The Pakistan misused the pious religion in the politics by injecting the venom of hatred and poisoned the atmosphere, which was contrary to the secular democracy. This tactic was followed by Pakistan to woo the Muslims by exploiting their religion, exerted its efforts to the maximum extent to turn the political issue of Kashmir into a purely religious issue. The Pakistan, afterwards, propagated misleadingly against India on international level that it had gone back to its commitment for plebiscite and started hatred campaign to lower down its reputation in the world. India had never agreed to process plebiscite in a incited atmosphere where sentiments of the people are touched by the weapon of religion.. However, India had committed plebiscite under certain circumstances, especially free from religion which was not provided by Pakistan and it was not for ever long.
Pak-malicious and fictitious propaganda regarding so-called commitment based on concocted and groundless for demilitarization from Kashmir and holding a plebiscite under international auspices was totally misleading and was no where in any record. The plebiscite for Kashmir was conditional. as such these allegations was totally groundless and whimsical.
