Maintain status-quo for six weeks: HC | Katra bus stand row | | EARLY TIMES REPORT Jammu: Oct 25:- Justice Sunil Hali of J&K High Court (Jammu Wing) in a petition filed by inhabitants of Katra challenging the acquisition of land for the construction of Bus Stand, has directed the parties to maintain status-quo for a period of six weeks. In the petition filed by Avtar Krishan & Ors all resident of Katra Tehsil & District Reasi challenged the notification dated September 23, 2010 issued by the Commissioner/ Secretary Revenue Dept and notification dated October 14, 2010 issued by Collector Land Acquisition (AC Revenue) Reasi as null and void, ineffective against the right of the petitioners and their respective land mentioned against their names in the notification dated October 14, 2010 and seeking quashment of the said notifications and also seeking quashment of all proceedings initiated for the acquisition of land for the construction of New Bus Stand in the heart of Katra Town by removing entire vegetation and depriving Katra town of its lungs. It is also submitted in the petition that since the acts of omission and commission of the respondents depriving the petitioners of their fundamental rights of ownership and user of green area in the shape of Orchard in the heart ofKatra without following the provisions of the relevant land and the procedures prescribed by the constitution of Land Acquisition Act and alleged that respondents remove the only green patch in the heart of Katar Town which works as a heart and lungs for Katra Town and substitute it by flith generating facility like Bus-Stand and seeking quashment of the notifications which were issued on the name of the Public Interest. The court after hearing Advocate AV Gupta assisted by Advocate Aditya Gupta for the petitioners issued notice to State of J&K through Commissioner/Secretary to Revenue Dept and Collector Land Acquisition (AC Revenue) Reasi returnable within four weeks and directed respondents to consider the objections and dispose of the same after hearing the petitioners within a period of one week from the date a copy of this order is received by them and for a period of six weeks status-quo shall be maintained.
