Cigarettes, tobacco banned in Govt offices in Jammu and Kashmir

SRINAGAR, Oct 25: Jammu and Kashmir Government has banned the entry of persons carrying cigarettes and tobacco products in all government offices with immediate effect.
However, the ban on cigarette smoking at public places, including bus stands, hospitals, parks and restaurants was a total failure as people could be seen smoking everywhere, including public transport, with no checking.
A notification issued by Kashmir Divisional Commissioner Dr Asgar Hassan Samoon said it has been observed that some people including officials and non-officials carry cigarettes and other tobacco products inside offices and have been found smoking in public places.
''Smoking in public places has been banned by government under the Cigarette and Other Tobacco Products (Prohibition and Regulation of Trade and Commerce, Production, Supply and Distribution) Act 2003 (COTPA).
''It is, therefore, ordered that no one shall be allowed to carry cigarettes and tobacco products in government offices,'' said Aamir Ali, Officer on Special Duty (OSD) in the office of Divisional Commissioner, Kashmir.
He said during a seminar on anti-tobacco, organised by Voluntary Health Association of India (VHAI) in collaboration with the Kashmir Divisional Administration here recently, an assurance was given that entry of persons with cigarettes and tobacco products would be banned in government offices.
He said the VHAI had filed a PIL in Jammu and Kashmir High Court to ensure implementation of Sections 4 and 6 of COTPA, which prohibits smoking in public places.
Under the Act, smoking in public places has been banned and any violation of this Act, is punishable with fine upto Rs 200.
Section 6 (a) of COTPA prohibits Sale of Tobacco and Tobacco products to persons below 18 years of age and Section 6 (b) of COTPA puts a ban on sale of Tobacco Products within 100 yards of educational institutions.
