| A case of cops taking back stolen jewellery from its owner | | Court directs police to release “seized” items in his favour | | Early Times Report
Jammu, Oct 26: It an alleged case of police giving possessions of the stole jewellery, which they recovered last week from two burglars, to his owner and then taking it back from him.
On October 20, police apprehended to alleged burglars -- Neeraj Chandel alias Lucky and Sandeep Anand alias Sunny -- and recovered 73 gold rings they had stolen from the shop of Rakesh Verma at Pacca Danga here.
The alleged burglars were produced by police before media persons on October 20 last.
The 73 rings, recovered from there possessions, were returned to Rakesh in the presence of reporters and lensman of local newspapers.
However, minutes after this “handing over” ceremony, police took back the jewellary from Rakesh. When he did not get back his jewellery, he moved the court of special judicial mobile magistrate, (excise Jammu). The court, after hearing Rakesh’s lawyer Anil Sethi, ordered the release of the 73 rings in favour of the petitioner by imposing suitable conditions on Suberdnama. The court said the petitioner “shall undertake to produce the ornaments in the same condition, in which they are released in his favour, before court or police as the case may be, as and when required”.
The court further directed him to furnish and undertaking to the extent that in case any better claimant appeared and stake claim to the ornaments would either restore them to such claimant or indemnify the every loss caused to such claimant.
The investigating officer (IO) was also directed to get each ornament weighed separately and prepare a detailed inventory thereof clearly mentioning the name and kind of each item along with its number and weight.
The court also directed the IO to get ornaments photographed from various angles so that they were clearly identifiably, besides asking him to get the inventory and the photographs attested by the applicant and two witnesses.
