Court directs further investigation

JAMMU, Oct 30: The court of special judge Anticorruption, AK Koul today directed the VOJ to hold further investigation in cases registered in 1999 against former Director IPP, Inder Singh Wazir and others.
The court today directed Vigilance Organization Jammu to further investigate the cases under FIR No 79/1999 and 80/1999 u/s 5(2) PC Act against then Director IPP Inder Singh Wazir and then Accounts Officer Vikram Dewan and Harinder Mohan Singh owner of company and Ghulam Ahmed Bhat owners of the company who supplied steel and wooden furniture in the year 1998.
According to the VOJ during the investigation of FIR No 75/1998 it transpired that accused No 1 then Director IPP in connivance with then Accounts Officer abused his official position as a public servant and made purchases of steel and wooden furniture during the year 1998. After their alleged fraudulent deal surfaced case under FIR NO 79/1999 and FIR NO 80/1999 came to be registered against the Director IPP and then Accounts Officer and the suppliers in each cases.
Court after hearing CPO for the VOJ, Advocate Rakesh Badyal for the Director IPP, Advocate Ashok Parihar assisted by Advocate Rajnish Singh Parihar appeared for then Accounts Officer IPP and Advocate Raghubir Singh appeared for the suppliers observed that accused then Director and Accounts Officer calimed that they were acting under World Bank directions and what ever they did was lawful and strictly in accordance with the said scheme and they gave documents to IO but he ignored them completely. Ordinarily once the controversy was raised by accused and pre-judice was claimed by them the prosecution should have on its own sought permission for the conducting further investigation thereby completing the deficiency in the charge-sheet but that has not happened so Court is constrained to exercise its powers and directed the Vigilance Organization to conduct further investigation in the matter, more particularly in the areas pointed out by the accused, without being pre-judiced by the observations made. Special Judge Anticorruption directed VOJ to investigate the matter further in the light of the documents collected from accused and thereafter submit reports along with those documents. It is further said that IO is at liberty to accept/reject those documents. The matter is very old now, so it would be appreciable if the investigation is carried out as earliest as possible. JNF
