‘J&K deliberately delaying 73rd, 74th constitutional amendment’ | Empowering Panchayats | | Early Times report JAMMU, Oct 30: The State Government has drawn a flak for its failure in the implementation of Constitutional amendment 73rd and 74th in J&K which gives wide powers to democratic institutions in the state at grass root level. The BJP, which for years together has been pressing for the implementation of the Constitutional amendments in the state has taken a serious view of the delaying tactics adopted by the State Government in this regard. Even Prime Minster, Dr Manmohan Singh during his last visit to the State has publicly asked the State Government to implement the Constitutional amendments to make the Panchayti Raj system a reality in the state. However no headway has been made in this regard so far and instead of implementing the Constitutional amendments, the State Government has come out with its own Panchayti Act saying that it has much wide features than the Constitutional amendments. Contesting this argument the BJP leaders said that the Panchayti Raj Act of the J&K has many flaws and the State Government should explain what extra features and benefits it has than the Constitutional amendments. Under the 74th Constitutional amendment the Municipalities in urban areas have been given wider powers while under the 73rd amendment the Panchayats have been given the wider powers in the country and all states except J&K implemented the two Constitutional amendments. The BJP has accused the J&K Government of deliberately delaying the implementation of the same as it amounts to extending of Indian Constitutional jurisdiction over the Panchayats and municipalities in the state. The late Prime Ministers, Rajiv Gandhi and P V Narsimha Rao who had given much thrust on the empowerment of Panchayats and making Panchayati Raj system in the country a reality wanted to strengthen the basic democratic institutions of the country, said a BJP spokesman. He, while criticizing the J&K Government for showing indifference in the implementation of the amendments said State Government itself admitted that it has lost Rs 297 crore during the last budget due to non constitution of Panchayats in the state and the special Central assistance given for the development of state through Panchyats lapsed. Not only the BJP but other opposition parties also hold the coalition Government responsible for making a mockery with the functioning of the basic democratic institutions. Last time half of the Panchayats were not constituted in the state and though the elections are now over due for both Municipalities and Panchayats, the State Government is deliberately delaying them, allege the opposition parties. They said that under the Panchyati Raj system the powers are given to Zila Council for the development purpose and they become accountable to the elected bodies while in J&K these powers are given to deputy commissioners who are accountable to none. The opposition parties while criticizing the State Government said that till date only four times Panchayat elections were conducted in J&K while in other parts of the country they were held 12 times. When Constitutional amendments were applied in all other states of the country why J&K will have its own Panchayat Act, they questioned?. |
