Do not close Banquet Halls: HC | | | EARLY TIMES REPORT JAMMU, Nov 4: Justice Mansoor Ahmed Mir of J&K High Court (Jammu Wing) today directed respondents not to close banquet halls of the petitioners. In the larger interests of the public as the marriage season has commenced, a petition has been filed by 51 banquet halls challenging the SRO 64 of February 16, 2010. Today Justice Mansoor Ahmed Mir after hearing Advocate Sunil Sethi for the petitioners issued notice to State of J&K through Chief Secretary, Commissioner/ Secretary Housing and Urban Development and Commissioner Jammu Municipal Corporation returnable within two weeks. Court also permitted dasti service. Court further ordered that in the meantime subject to objections from other side, respondents are directed not to close banquet Halls of the petitioner (subject matter of the petition) till next date of hearing and directed Registry to list after the service. While giving relief to the people of Jammu in the coming marriage season, Justice Mansoor Ahmed Mir further observed that the petitioner are running the banquet halls for several decades. The Govt has issued SRO 64 of February 16, 2010 whereby Master plan of Jammu 2021 came to be modified. It is contended by the petitioners that the said SRO has been made applicable retrospectively which is violative of provisions of constitution, discriminatory, irrational and unreasonable. It is also averred that the respondents have issued notice dated October 30, 2010 whereby objections have been invited within sixty days from the date of publication. The petitioners apprehend that the aim and object of the said notice is to close down there banquet halls. Upon this Court directed respondents not to close banquet halls till next date of hearing. —JNF |
