Residents appeal CM to prevent encroachment in Channi Himmat | | | EARLY TIMES REPORT JAMMU, Nov 7: Fearing large scale encroachment of Green Belt of Channi Himmat by certain influential big wigs, the members of the Residents Joint Action Committee have appealed to Chief Minister Omar Abdullah to prevent the 'loot' and direct the concerned authorities to develop the land. General Secretary of the Residents Joint Action Committee PL Kohli on Sunday said that well oiled official machinery is silently watching encroachment of green belt area in Channi Himmat much to the chagrin of the local residents. He said in the first week of July 2010 some miscreants took up huge unauthorised construction on this green belt land and when the hue and cry was raised by them the Executive Engineer of the Housing board filed an FIR against the encroachers. Ironically, instead of taking action against the land grabbers the residents have been informed that the case has been sent to the Revenue department for verification and scrutiny. Smelling foul play behind the curtains the members of the resident Joint Action Committee said that when the division bench of the state High Court in April 2006 had dismissed all the litigations filed in the court of the law had held that the entire land meant for Green belt, belongs to Housing board why then the case has been sent to the Revenue department. Interestingly, after the scrutiny of records under the supervision of ACR, Jammu for couple of days a full team of officials consisting of concerned authorities visited the site on July 22 with the intentions to take Nishandahi (demarcation) and start work simultaneously with the assistance of the police. Even the housing board has released a sum of Rs 75 lacs for the development of green belt park in the colony but no progress has been registered.After some time when a deputation of the channi himamt residents met ACR on August 20, 2010 in his office and held a detailed disucssion the ACR as per his version of record has conveyed that the intqals (mutitions) of the year 1977 show ownership of some other persons.The ACR also informed the members of the delegation that he has not been aware of High Court's decision of 2006 nor he has read it before submitting his own report to DC Jammu. Kohli, said at the time of developing the housing colony vast spaces of land for Green belt, Channi Himmat colony was acquired in the year 1981 after giving compensation to the owners of the land. Next year in 1982 Housing board authorities took over the possession of the land from the Revenue Department. The green belt was properly marked and subsequently developed by the J&K Housing board and Forest department. General Secretary PL Kohli said once the land has been officially handed over to the Housing Board it is their property and there was therefore, no legal necessity to send the case at this stage to ACR for his pinion when even High Court has already taken cognizance of all the aspects projected by ACR in his report. Referring to the Supreme Court ruling the members of the resident action committee said that even the Apex court has banned change of land use meant for green parks for commercial use and residential purposes. No person can, therefore, raise any unauthorised construction on this land stretch whatever may be the position of the title of this land.
