JAMMU, November-09 (JNF):- In a much publicized purchase scam of crores of rupees in the year 1993/1994, Special Judge Anti-corruption, A.K. Koul today acquitted Dr Ali Baksh, then Special Secretary Health & Family Welfare, Dr Ghulam Massi, then Deputy CMO, Sudershan Kumar Gupta, Additional Treasury Officer, Saddar Treasury , Joginder Khajuria, then Supt Saddar Treasury, Romesh Chander, then auditor Saddar Treasury Jammu, Gurdeep Singh store-keeper Family Welfare Store Jammu, Amarjeet Singh, Ved Parkash , accountant in the office of Deputy CMO, Jammu after the investigation and Trial of the case more than 16 years.
According to the case that a communication in the form of DO Number GAD (SER) dated November 9, 1994 addressed to Director General Vigilance Organization.
Special Judge Anti-corruption, Jammu, AK Koul in a much publicized medical scam at that time after hearing Chief Prosecuting officer appearing for the VOJ and M/S LK Sharma & Ejaz Ahmed Tak Advocates appeared for the accused and also gone through the record and the statement of the witnesses observed that the only conclusion flows out of decision is that nothing stands established against Dr. Ali Baksh who as per prosecution case was the fountainhead of all mischievous deals and deeds. Similarly other accused persons have been booked and put to trial for no plausible reasons. None of the witnesses have deposed against them. They are alleged to have conspired with alleged accused Dr. Ali Baksh but not even an iota of evidence has been led against them to show that they have any point of time connived with Dr. Ali Baksh to do any illegal act or a legal act by illegal means.
Court further said that either the evidence which was not necessary to bring home charges against the accused has been deliberately withheld or the Investigating Officer has demonstrated his incompetence to collect the material evidence to connect guilt with guilty. With these observations Court dismissed the case and acquitted the accused from all the charges leveled against them as the case false miserably fails for wants of evidence. JNF
