Anti-India speech of Geelani, Roy; court to record statements

NEW DELHI, Nov 10: A court here today decided to record statements of complainants who have sought prosecution of Kashmiri separatist leader Syed Ali Shah Geelani, writer Arundhati Roy and Delhi University professor SAR Geelani for alleged sedition for their "anti-India" remarks.
"A fresh complaint received. Arguments heard. List the case for recording pre-summoning evidence of the complainants on November 27," Metropolitan Magistrate Navita Kumari Bagha said.
The court, which had earlier asked Delhi police to file a report by November 16 after taking note of another complaint on the issue, said the decision to summon and prosecute can only be taken after perusing the evidence.
The order was passed on a complaint filed by former Delhi University Students Union president Nakul Bhardwaj, activist Abhishek Kaul and Juhi Arora, a lawyer.
The complainants want prosecution of Geelani, Arundhati and others under various provisions of the IPC and the Unlawful Activities (Prevention) Act dealing with various offences including that of sedition, waging war against India, showing disrespect to Indian tri-colour.
Syed Ali Shah Geelani, the hardline Hurriyat leader, Arundhati and SAR Geelani, an accused in Parliament attack case who was later let off, had taken part in a convention on 'Azadi-The Only Way' here in which they had made "anti-India" speeches, the complaint said.
Arundhati had said Kashmir was never an integral part of India. It was a historical fact. Even the Indian government had accepted this, it said.
The court took note of the complaint and fixed the case for recording the statements of three complainants on November 27.
Earlier, a similar complaint was filed by Sushil Pandit, also a Kashmiri activist, alleging the prima facie case of sedition was made out against them for "openly challenging" the integrity and the authority of Government of India.
